RFE for a document that I sent with the original package

Timeline

Hello everyone,

How often is it that one receives a RFE for a document already sent with the application? I sent in a copy of the dissolution certificate for my husband's traditional marriage which technically dissolved years ago. The marriage was formally dissolved in customary court last year and now I got a RFE requesting for evidence of the dissolution of the marriage or a court decree dissolving the marriage.  I intend to resent the court order again but want to make sure that I am not missing anything else.

Has anyone been in a similar situation?

It is not common but it does happen that some documents are misplaced or lost out of a packet. So resend the paperwork that you have.

It's more likely that you sent in the wrong document.  I had to provide an ORIGINAL DIVORCE DECREE that was stamped by the court.

Was it a photo copy or a certified copy printed out by the court? 

 

Either way, just send it in again. I'd recommend getting a new fresh copy direct from the courthouse though, just to err on the side of caution. Sometimes they ask for things already sent because they lost it, or because they don't like something about the copy that was sent it... unfortunately, they are never really exactly specific about that.

My RFE asked for proof of US citizenship even though I sent a front and back copy of by birth certificate. I sent a second copy of it and a copy of my passport. Things get lost when you have physical copies, and since they are switching systems that has the potential to be a double whammy. I wouldn't be concerned since the paperwork has been sitting in their office for 6+ months.

You say copy of... Just to be clear, I would not send a photocopy of it (as in if you took what they gave you and put it through a copier), I would sent the the one given to you by the court, that has a stamp directly on it. If you don't have an extra to send, they are like $5 or $10 at the courthouse.

I thought we are not supposed to send originals to the USCIS? This document came from a court abroad

You don't want to send the "original" you want to send an "official copy", not a "copy" of the original, if that makes sense.  Others might a copy is fine, but you send that once adn got an RFE.... you can try sending the copy again, but in my opinion it's better to take the extras step than just hope for the best with what you already tried once.

So you sent in the original divorce decree. Did you submit a photocopy or certified copy with the original application?

Your husband is the beneficiary why did you send in the divorce decree to USCIS? His divorce papers are to go to NVC. They probably confused
USCIS is all about the petitioner. NVC is about the Beneficiary.

I had the same thought - my husband (beneficiary) didn't present his divorce decree until his interview at the embassy. At that point, they took it along with his passport before issuing the visa. It didn't come up before that.

 

Either way - as others have said, get a certified copy (not just a plain photocopy). My then-fiancé had a certified copy that was also certifiably translated to English by a Swedish notary and it worked just fine. (Not sure if translating is an issue for yours)

As per USCIS you are NOT to send originals to them. You are to bring originals to the interview.
