So my Fiancè, in the i-129f form, ticked the yes box in the 'if she has ever been arrested,convicted,etc' question and explained she was arrested for a DUI in 2014, but she didn't mention some petty larceny case(always in 2014) as she thought it was only about arrests. At the time we sent the application(November 2017) she hadn't solved either case yet for various reasons but in a few months she completed the CS hours, paid all the fines and the court closed both cases in March this year. We got all the signed papers from court as we knew a RFE was likely coming, and indeed last week they issued one and it was for her criminal history, so of course we'll mention both cases this time and send all the papers but is there any chance we might get denied because the cases were still open when we sent the application and we only solved them while the application was pending or is that rule just for the 2 year in-person meeting requirement?

Is she the immigrant or are you? fill out your timeline, it will help anyone trying to help you.

 

Just give them everything they ask for. They are not offenses that would prohibit you sponsoring an immigrant. You have the paperwork, thats all they want. make sure you keep copies!

 

They really are trying to make sure the fiance who is moving to the US is aware of all of it.

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....
