affidavit of support for Mother

My wife in the future wants to petition for her mother to come to the US as a permanent resident once my wife becomes a US citizen.

 

My question is will the i864 be based solely on her income or based on our household income what we report to IRS??  When we file taxes it is joint so including my income we could support a household of 25 people or more according to US poverty guidelines.  

 

Wife's income is self employed and after business expenses will put her below threshold I hope to prevent less self employment taxes.

She will need to be a sponsor for the I-864. As her spouse, you should complete an I-864A to join your income & assets with her. If that's not sufficient, then a joint sponsor can be used as well.

 

As a self employed individual, her tax returns would be the primary source to show her income (using the AGI).

Thanks.  I see it now.  Section five she can include me as the spouse and the household income will be more than sufficient

You can become a joint sponsor to make up short fall but make sure you understand what you are signing.

Typically they will want an I-864A (not a joint sponsor) from a spouse either way, since the income/assets are part of the marital arrangement/property.

I am applying for my mom. Even though I’m a stay at home mom with zero income, I still HAVE TO be her sponsor on I-864, like others said. My husband will be on I-864A.

 

I will enclose my tax return transcript as evidence of I-864, and my husband’s for I-864A. (We file jointly, so all numbers are identical, but better safe than sorry)
