I just saw that a person in the June 2017 forum who is now waiting nearly 450 days filed a lawsuit against USCIS because he hadn't heard a word.  Once he filed the lawsuit USCIS had 60 days to respond and he just received an RFE.  It might be an option to consider if you have tried other options to no avail.  The process is broken for sure.

That is insane! It's not like we are expecting this service for free! If one service center is overwhelmed,  then they should either shift work to another center or hire more people!

Congratulations! =D I got a letter response to my phone call stating my case is on hold because of security checks...ridiculous. Put in a request with my senator today.

 Hi @Greenbaum My fiance lost his job this month and we are worried about filling up the Affidavit of support because he dont have a current job. His 2017 tax report passed the poverty guideline however he dont have a job right now so we dont have last 3 months proof of income and COE. Is it okay to have co-sponsor for k-1? and if we dont have a co-sponsor..can we do the interview 6 months from our noa2?? We really want to do the interview by October but we are nervous what if we got denied because they wont accept co-sponsor :( or we can just wait for the time he already have a job then i can schedule my interview?

All Embassy's are not required to take a co-sponsor but USEM is one that will at least look at the submittal paperwork. Most times they approve but again, they don't have to. If you want this to happen in Oct then a co-sponsor is the way to go. Your petitioner still will be required to submit at the interview their financials.

 

EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form K1/K2 Interview Preparation Instructions – English (February 2014)  Page 3 of 9 with original signature will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134.

 

US embassy Manila prefers that the joint sponsor for K1 is an immediate relative of the petitioner (ex: parent or sibling).  They do not have to except the co-sponsor for a K1, but each case is different. We have seen approvals and we have seen rejected applications. 

 

If the K1 visa application fails, you can take the spousal route. You would marry in the Philippines and then file for a visa In the IR1/CR1 category, the joint sponsor can be anybody (relative or friend) as long as they meet the requirements.  This process the CO must take the sponsor.

 

A Joint Sponsor must meet all these requirements;

 

1.  Be over age 18; AND

2.  Be either a USC or LPR; AND

3.  Be domiciled in the US; AND

4.  Meets or exceed the 125% poverty level with income and/or assets for his/her household size
