November 2017 I-129F Filers, Part II

Day 266 and still nothing. I called USCIS today and was given the same runaround. Wondering if anyone else is still on hold pending security checks? Im frustrated because they won't tell me if there is a problem with mine (petitioner) or my fiance's (beneficiary) background check. The reason I want to know is a couple of weeks ago he crossed the border from Jordan into Saudi to see his parents and was stopped. He was told there is a similarity in names. There is another man with the same exact name whose mother's name is the same as my future mother-in- law who is wanted for stealing. When my fiance followed up at the police station on the confusion, he was told not to worry about it since the wanted man was born in '74 and my fiance was born in '85. They have completely different national ID numbers so they told him it shouldn't be a problem. Im worried that this is what is causing our delay and if there is anything I can do about it. I contacted our local congressman today but the person in charge wont be back for a week. Do you guys think this is something they can help with or am I wasting my time? Im just getting so depressed without my fiance, I can't afford to go see him and the last time he applied for a tourist visa he was denied along with everyone else who interviewed at the embassy that day. I just feel so hopeless, it's getting harder and harder to just wait without knowing how long this is going to take. Is there anything I can do to figure out why we are delayed? :(

Day 275 for us. sent our RFE and no communication from USCIS on whether they received it or not. Fiance called and was told to wait. Is there anything wrong with not receiving an acknowledgement from them

When did you mail it to uscis?

 

I am a January filet and mailed my rfe last Thursday and post office said it was delivered on Saturday but still haven’t received any notification myself ,

So after having gotten all the way to the point of having an interview scheduled only to have our case sent back to the USCIS from the embassy we finally got a hardcopy of our NOA2. I've updated my timeline. There's no way to reflect the oddball events of our case so I'm treating it as if we never got an approval way back in June and it was just barely approved now.  You can read up on my older posts to see what I'm talking about as I don't feel like re-hashing the past all over again. I'm just happy we finally got something. 

 

NOA1 Received : 11/8/17

NOA2 Received : 8/3/18

 

Old website still says received 11/8/17.....ridiculous

New website says approved 8/3/18

 

A whopping 270 days from start to finish....again, ridiculous

 

I still don't consider us quite in the clear yet so just praying that we don't have any more out of ordinary experiences.

I been watching u from a distance. Yes u got screwed badly by uscis. Glad it's working out in the end. Hopefully no more speed bumps along the way for the both of u..

IN REGARDS TO WHICH DATE TO USE!!!!!!!!!!!!!!!!!!

noa1 date is actually they date on ur hard copy. Sadly if u reach the magical 220 day u must wait till 225 to contact Uscis. They use what the new site says. Even if ur paper says X date. 

They added 5 days onto everyone’s accepted on NOA1

I know the wait is killing, I am too still waiting not as long as you though  Day 225 here.

Not wanting you to rehash either but can you elaborate on the experience inbetween it being sent back to USCIS and now? 

What procedure did you take?

Who did you contact and actually get a response from? 

Or were you in the dark the whole time?

I have been following the debacle that they have put you through and the only thing positive thing I can think that may come out if this is that you may be able to offer advice to others who end up in a similar situation. I know there are a few others further behind you on getting it resolved and I know there will be others in the future.

There really isn't any procedure other than to wait. 

 

I wrote to both Ombudsman and the local Congressman and got responses from neither which basically leaves me to believe that they are about as helpful as a lawyer. 

 

The only actual communication I had with the USCIS was me calling and emailing them. The emails were iffy as I never received any replies other than the standard cut and paste responses. 

 

Whenever I called I got a different answer ranging from "don't worry you'll get it soon" to "you need to be patient and wait" all the way to "we never approved your application, I don't know where you're getting your information from" and even a "sorry, I can't help you because I can't see your case, you'll need to contact the service center directly, (CSC) here's their email address".  And these were all Tier 2 Officers. I won't even discuss Tier 1 as those people basically only see what we can see on the old and new tracking websites (basically nothing). So every time I called to check up I had to butter up the Tier 1 operators for a bit before they would finally send me over to a Tier 2...dumb. You would think they would at least try to maintain some sort of consistency by directing inquiries from the same cases to the same officers to avoid having to start the explanation from the beginning every single time. 

 

So that's my experience in a nutshell from the time the embassy shot back our case to USCIS to now. 

 

In conclusion, if your case happens to make it to the NVC and is sent to the embassy despite not having received your NOA2 receipt.....just proceed without doing anything. Don't, I repeat, don't call/write the USCIS, Congressman, or anyone else for that matter to ask why because if you do, the USCIS will recall your case and you'll be stuck waiting an additional month or more if that. 

 

You don't need your NOA2 receipt hardcopy.

I’m still on hold pending security checks - day 296. I know it sucks and you feel like there’s no end in sight.

 

No matter how long the wait is, an answer will eventually be given.

Congrats on getting your noA2. 

Just so that People here don’t get incorrect information from you and as it has been posted many times before you may not need your noa2 for an interview but per the uscis instructions you do need it for adjustment of stAtus.  Read the instructions carefully and you will see it there as was explained to you a few months ago.

Hey guys...I have a quick question on the 134 and using a co-sponsor... @Greenbaum @K1visaHopeful anyone else in the know ;) 

 

Do we count those in the household of the co-sponsor PLUS myself and fiance? Or JUST their (co-sponsor) household and fiance household?  I *thought* I knew this answer, but was just confused by my lawyer (that situation is so frustrating in itself!) so wanted to clarify with those that actually know...

4-21-21 Received by USCIS (Signed by T. Wright)

5-7-21   Receipt date on our 797 (extending GC for 18 months) {we included G-1145, got a text, but no email - for those curious.}

5-8-21   Received Text message from USCIS with receipt number, Assigning service center SRC. (@12:35pm) 

5-10-21  Check cashed/cleared our bank

5-13-21  Hard copy of 797 Received in postal mail

5-17-21 Received email notice update from USCIS account that on 17th they used his previous biometrics for 751.

5-21-21 Biometrics letter received in postal mail.

I may stand corrected but:

1) Co-sponsor's household plus the foreign beneficiary and any K2's (dependents travelling with K1 at entry) on the Co-sponsor's I134. They are not responsible for the petitioner. 

2) Petitioner's household plus the foreign beneficiary and any K2's (dependents travelling with K1 at entry) on the Petitioner's I134.

@K1visaHopeful So we combine household sizes? Even though we dont live in the same house? (just trying to clarify here..) Everything I have come across to this point said only who is claimed on taxes (i.e. Her household Plus fiance) would be the household size. And my income would cover myself and my household. Is this not right?
