I'd contact Ombudsman, then a Congressional case worker, then an immigration attorney (they have online ones for cheap)

Yep, that's what I consider doing, the case left NVC on July 20 and is obviously still in transit, as uscis has not received anything yet, so just waiting for it to reach to uscis.

Hi,

Has anyone here or from the previous months filed a request with Ombudsman or state senators after crossing the normal processing time and received any kind of positive help through them?

My NOA1 is Dec 26 and I am at 213 days.

I've contacted both.

My congressman I did about a month ago and Ombudsmon just recently.

I received zilch from the congressman, not even a receipt despite even having checked the checkbox that specifically asks for one.

I at least got a receipt and some form of inquiry number from Ombudsmon.

I too am curious about your question. Looking back and doing searched I haven't seen anywhere where anyone can actually confirm that they yielded positive results in doing so.

Doesn't mean it's not worth a try though but it would be interesting to see if others can provide input on your question.

My thoughts are with those still waiting for their NOA2.

My fiance and I had our interview on July 9th. We are waiting for the visa to be processed.

We provided all requested documents. My fiancé has twins. Although we've expressed they are not expected to follow…we were asked to provide their birth certificates to be processed (the NVC creates cases for children of the beneficiary).

In hindsight, I can see why the consulate would want their info…in case something happens to the mother.

I was quite frustrated because I felt like we should have been notified to have the birth certificates for the children whether they plan to follow or not. We would have had the documents at the interview and would not have been delayed in the having the visa processed.

Good news, is we are approved…documents were received for processing. The CEAC site shows that the case has been updated twice last week.

We're praying for the issued visa this week.

I extended my stay a whole week hoping he'd be able to travel with me. Unfortunately, that did not happen.

God willing…we will be blessed with the visa this week. In God's time….we are thankful to be able to receive the visa.

I talked with the NVC this morning. In which, I was told that the NVC should not have created cases for them since K2 visa petitions were not submitted.

An additional spend of $1k and 3 weeks later, I am instructed to send an email/letter to embassy explaining error of NVC and send request to remove the children and issue visa.

I was also told a letter requesting further proof that he is their father was sent last week. The birth certificate with his id # wasn't enough? Good gracious people!

Ahhh! I went dress shopping today and found my wedding dress! It was the second one I tried on and it fit so perfectly that my consultant said that if the dress couldn't be ordered in time that I could buy the sample size. Luckily, it should be in by August 27th and my fiance should have a POE by late September or early October! My mom started sending potential ceremony locations as soon as I let her know I had the NOA2 in hand. We're hoping to do a small ceremony with family only in October and then go to a dinner after. Then several months later once my fiance is settled into living here and gets to know more people have a reception with friends, and family.

Im just so excited that I have a dress and I wanted to share! Its finally starting to feel like all this stuff is really happening!

I have known other cases have been approved shortly after an inquire either by the O or the State Senator was submitted. Can I say with 100% certainty that it was because of their inquiry? NO  Nothing ventured nothing gained. December approvals are coming fast an furious. I'm sure you will have something soon. Your still within the current processing time but not what was promised. There are some in December that are still lingering and there are some in January and now we are starting see approvals for Feb. Can't say for sure why yours is taking this much time but there must be something that they are continuing to vet.

We got approved month of May and still waiting for NVC. We called them numerous times and emailed at the same time and says the same thing, they did not received our case yet. Its frustrating when some got their case number two weeks after they got approved. Is there anyone here waiting for case number and got approved month of May?

How to Track the Status of Your Case

Check your case status online with your receipt number. You can also sign up to receive automatic case status updates by email.

If you do not receive a decision on your case within the published processing time for the new service center, you may submit an inquiry online or call the USCIS Contact Center at 800-375-5283. For people who are deaf, hard of hearing or have a speech disability: TTY 800-767-1833. When asking about your case status, please provide us with your receipt number and specify that your case was transferred to a new location.

If we send you any notice (such as a Request for Evidence), please read the notice carefully and follow the instructions provided.

If you move while your case is pending, you must inform USCIS of your address change. You may file a change of address on our website or by calling the USCIS Contact Center. It is important that you notify us of any address change as soon as possible, so that you continue to receive notifications from USCIS.

There are a fee of the ways to contact USCIS. You may need a tier 2 agent or a supervisor. It's time to bring out the big GUNS.

Thanks @Greenbaum  as always.

But what do you mean by “I am within the current processing time but not what was promised” ? I couldn’t understand that.

Do you think they are vetting my case specifically more under scrutiny (meaning more background checking n

all)  ?

Another thing, Ombudsman page clearly says to file a request after 60 days have passed but If I file a request today - would they consider it or no?

Thanks as always for your help :)

Do you think they are vetting my case specifically more under scrutiny (meaning more background checking n

all)  ? No on can predict with accuracy when your case will be approved and likewise for what is influencing the longer wait times that all are experiencing. I know you want your approval, as I did to when I was where you were. But what I learned is if I have the same timeline as others then I am not going to have a big beef with the governing authority that has jurisdiction over my case. I just went about my daily life.

Another thing, Ombudsman page clearly says to file a request after 60 days have passed but If I file a request today - would they consider it or no?

Thanks as always for your help :) I'm not sure how they view early submittals. Some have gone through others have been denied till 60 days has passed.

USCIS states that your application will normally be vetted within a 5 months window and if your case takes longer then it is outside the window. Currently the outside of the window has people into 6 and 7 months. Just like yourself. So currently USCIS is processing at a pace of 6-7 months so you are within the "not promised window".  So you are within the window of what most others are experiencing. That's what that means.

Have you tried to look up the NVC case number on the CEAC website to see what its status is?

I have heard of cases returning to USCIS from the NVC because of processing errors that were recognized at the NVC but I have never heard a case being returned to NVC from the embassy. It will he interesting to see what your status is on CEAC.
