If you have an unreported divorce I'd advise you to bring the divorce paperwork that you did not include to the interview. I wouldn't volunteer the information as that could have a negative impact, but if asked then produce the document. Sometimes it's best to let sleeping dogs lie. ;)

No, no unreported divorces, I replied to the one VJ filer who received a RFE for not including all documents for his one divorce, he originally sent the final divorce judgment,  the same as I did,  thinking it was enough to prove divorce, but they didn't do that for me, the issue for my RFE was my beneficiary's 2 divorces, both needed to be translated from Russian to English...  I know what you're saying though, never volunteer information, answer only what you are being asked.  :)

This is not uncommon for NVC to neither send a text or email. Just a letter. That's why there is such a push to call and get your case number so you don't waste a month waiting for them.

@Greenbaum I sent 22 photos. They were posted to the Path social media app and showed the date that they were posted. Below each photo, I detailed the date, location, and circumstances of the meeting/photo. I also sent a list of video calls and phone calls showing daily contact for hours a day. I am US military, and was stationed at the Embassy in Indonesia from Dec 2013 through Nov 2016. In the packet, there was also a copy of my military orders, pay stubs, and a dated copy of a cable bill that I paid in October 2016.

I guess they just don't get it. I think that's enough evidence to show you have been together. Well, they asked for.... If they thought that what you originally was a little rain fall, you are going to destroy them with your typhoon of documents in your reply to their RFE. :jest:

Yep! They went from maybe 10 pages of stuff to 140. I even went the extra mile to tab out each and every date and photo, nice power point slides with arrows that clearly show the passport stamps, and dates that were highlighted with a yellow highlighter. I hope they enjoy the read. lol

 

Thank you for your service as well. I just retired after 21 years in the Army.

Hello guys, 

I do have a general question. I am currently a Medical Student and have been a private tutor for past 3 years. My income for last year was about $21,000 and plus I get loan money for living expenses etc. I do have money in the bank as well. My question is if there will be an issue for me in terms of sponsoring my fiance. Our I-129F was already approved here in the US and just waiting for NVC and then interview. I am just trying to figure out if I should have a co-sponsor or I should be okay?

That's a hard one, they rarely ask for proof of income, but if you put that you were unemployed on your application then yes you will most likely have to send your fiancé the sponsorship paperwork prior to the interview. If not it would be best to send over proof of your annual income as a employment verification.

If it's just you and your fiance in your household, you should be able to meet the requirement on your income. I would also list your assets on the I-134 just to further push the scales in your favor. 

 

It all comes down to meeting 125% of the poverty guideline for your household size, which you would barely meet.

Hi, thank you for your response. At the time, I was working as a medical assistant but decided to continue as a private tutor. I didn't say I was unemployed on my application because I was working as a medical assistant at the time. However, since I work as a private tutor, I am paid in cash by my students. I don't work through any company. However, I did pay taxes on the money I made as a private tutor. I hope that clarifies it. I don't know if this will be considered unstable income.

I would still send a copy of the W2's or tax returns just in case but if they don't ask for it I wouldn't bring it up.

Hey guys, Thank you for your responses. I really appreciate it. I will be bringing a copy of the tax return with me to the interview. I plan to attend the interview with my fiance. 

 

Also, this website shows that for the 2 of us the income for fiance visa would be $16,460 and about $20,600 for a marriage visa. I believe it has to be 100% of poverty guidelines for a fiance visa and 125% for a green card. Even though I will have enough money in the bank to show assets for the green card application, I am not sure if they allow it for a fiance visa. I am trying hard to find someone to co-sponsor just to be on the safe side.

I got absolutely nothing from the USCIS as far as updates go. The only update I received from the time I got my NOA1 was a message from the NVC stating that my approved petition had been forwarded to the appropriate consulate. 

 

Had it not been for the NVC informing me I would never have known my case was already at the consulate! Super annoying. 

Thank you for the information, I intend to call them first thing tomorrow to inquire about it

The "rule" is 100% for K1/I134 BUT most ppl will advise you meet the 125% because soon after you marry you will have to meet it on the I864. 

Basically the CO can decide for themself whether or not your income is high enough so it's better to be safe than sorry.

Also for K1/I134 you CAN report your savings as part of your income. Check out the instructions for the I134 and also threads for that form on here. You will find what income you can report, how to report it and what supporting documents you will need to prove it.
