1-485 interview complete, not approved yet, worried about worst case scenario job loss

Hey everyone, im a huge worry wort and thanks for listening.

 

Anyway Husband and I had the AOS interview last week, YAY. The officer did not have my 1-485 package, and maybe the 1-130 package (which has been approved online). He said they had already requested it. But how long does that take? he said we should know in a "few weeks", but didnt say anything more than that, just that they requested it, and will have to wait to make a decision. So he had my I-485 form, but that was it, didnt have the evidence or pictures etc. I gave him copies of all the evidence we have that I originally sent but I didnt have copies of the photos I had included in the original. So kind of a bummer, otherwise it went well i think. Gave copies of all husbands  last 2 months pay stubs, employment verification letter from HR, recent tax return. They really should have everything they need. He makes good income and has for years.

 

What im worrying about is, what if my husband lost his job in the meantime while were in limbo.  Would we be immediately denied if they found out? How often do they actually call employers? Or would we be given the opportunity to provide evidence of assets. He has enough assets totaling more that the 3x 125% poverty mark which would be required about $75, 000 in liquid assets if he has zero income. Between his retirement, house, investments, and some other things he more than has the assets to make up that number, much more actually. Would we be allowed to submit a new affidavit of support if this worst case happened? Or would they just say, sorry, you lose, go back to your country. :(

10/30/2017 | I-130 Package sent via UPS to USCIS. Was initially going to do consular processing.

11/06/2017 | NOA1 Priority Date Nov 6, 2017

12/06/2017 | AOS package sent (EAD, and AP as well). I decided to do concurrent filing/ AOS instead of consular processing. The lawyer I consulted scared me initially about AOS and that concurrent is more a sure thing, but I already work here in US under TN and did not enter with intent to marry.

12/11/2017 | AOS package received and received NOA1 for them all about a week later

12/30/2017 | Biometrics Appointment letter received 

01/08/2018 | Biometrics Appointment

01/12/2018 | RFE Received. (I forgot to have my husband sign the affidavit of support. Seriously OMG. I looked everything over 20 times.) Mailed the signed page back 01/13/2018.

01/25//2018 | RFE received. Case update says they will now continue reviewing my case. I was worried I would be sent to back of the line because of the RFE, but it didnt because 6 days later it changed to ready to interview!

01/31/2018 | Online- "case is ready to be scheduled!" Yipee!

02/10/2018 Online case update Interview date May 1!!!!

Your income almost has zero bearing on the interviewing officer's mind by the time of the interview unless there was already some major discrepancy in the paperwork (they would have sent an RFE/RFIE in this case) and/or if a major discrepancy comes out during the interview. For the most part, the interview and interviewing officer are there to: 1. Ensure you guys are who you say you are and are real people and 2. Ensure the validity and history of your romantic relationship and marriage. 

 

Just take a deep breath and relax. Is there any practical reason to be worrying about your husband's job anyway? As in, is his employer hinting of letting your husband go or are there rumors of lay-offs going around? If not, I literally have no idea what you're worrying about. USCIS are not the thought-police; they're not in our homes and workplaces monitoring every single aspect of our lives and waiting to deport any and every immigrant for whatever reason.

No there is no good reason to worry about his job. Hes been there 10 years. Problem with his work theres a lot of petty stuff that goes on. Someone gets pissed off enough over feelings they were slighted or whatever (work in sales), a few of these people will make stuff up and lie to save their own ### and to throw others under the bus. Id like to say its like working with children, but children act better than a lot of these people and that would be insulting to children. His employer will fire people on the spot no questions asked. So it could be possible, but i dont think very likely. Hes good at his job and a valued employee, but you know the superior has a bad day and you never know. And I know he could get a new job easily.

Anyway thank you, I know im worrying over things that arent even things right now, but my panties are in a twist just thinking of the what if scenarios. I just want to be prepared and am hoping will be allowed to submit an affidavit of support showing assets JUST IN CASE this were to happen :jest:. Prepare for the worst and hope for the best!

Until AOS is approved, the IO can request a new I-864. However, without a reason for them to want a new one, it's not an issue I would worry about. You don't have to provide a new one unless they request it.

If they do request it for whatever reason, you can use assets at that time, if necessary.

Totally understandable. Sounds unlikely they will ask for resubmission. Hope you get the approval notification soon!!!
