Kids can’t make the landing - now what?

Hi everyone, 

 

I won a DV and now waiting for my visa to come. It should arrive soon - just wondering if my kids are 18 and can’t make the landing, what next? What are my options? Can they come after the 6 months or before they’re 21 years old? What if one of them couldn’t join me for one reason or another - is there an option at a later stage after she turns 21?

If they can’t do it before their visas expire they lose out. Then after you become an LPR you can sponsor them. Requires filing I130 and paying money. Roughly 2 years wait if they’re under 21 and about 7 years if over. If they get married you won’t be able to sponsor them as an LPR (a citizen can sponsor married children, for now anyway, with a very long wait)

If you think they might want to come after not too long, they can always land to activate their green cards then go back, but will need to be back in the US again within a year (or 2 years if they file for reentry permits, but that takes time)

cost of extra return ticket for now may not be so much vs cost of filing new petition (I’m not sure of cost but know it’s much more than dv)
