NVC stage questions, IRS docs and police records

Hi all,

 

I am in the NVC CEAC stage w my spouse (payment should go through tomorrow or so), so I am not sure if it will let me select whether I want to submit the 864 or 864EZ for the AOS. If it does I want to submit the EZ form. Although I have enough income on the last tax report and W2 (only the last one, but also submitting the 2 prior ones), I also want to submit pay stubs and a letter from my employer. Can I do that on a/ with an 864EZ in CEAC?

To that effect. Is there such an employer support letter example around? What info should be in there?

 

Also, does somebody have experiences with explaining to NVC why one can't produce a police record (this particular Mexican state police record is not produced anymore, and the replacement is extremely hard to get if you are not in the country, which my spouse isn't. We still have 2 other police reports that we will show). Will this be fine with a letter explaining why we can't have the 3rd police report? Montreal embassy said they won't answer my question when I asked.

 

Also regarding the police report. It says that no translation of the doc is required if the language is the same as in the country where one is applying. The country where we apply is Canada, and the embassy Montreal, thus, is it OK if we leave the police record in french? This seems odd to me as I don't think the guys at the NVC speak french. Any thoughts?

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

After you collect your financial forms and supporting financial evidence, you and each family member immigrating with you to the United States should collect the civil documents that are required to support your visa application. You need to: 

  • Gather the documents that apply to you using the information below.
  • Send a photocopy of all required civil documents to NVC. (see submission instructions in Step 6).
  • Bring the original documents (or certified copies) plus a photocopy to your visa interview at the U.S. Embassy or Consulate.

All documents not written in English, or in the official language of the country in which you are applying for a visa, must be accompanied by certified translations. The translation must include a statement signed by the translator stating that:

  • The translation is accurate, and
  • The translator is competent to translate.

In Montreal, QC, Canada; French and English are official languages.

 

Anyways, the certified translation can be done by me, right? Like in the i-130 stage I just add a little note that states that it's accurate etc with my signature.

This is wrong.  English or the local language at the NVC and Consulate stages.  Only if, for example interviewing in France with Spanish documents would there be any need for translation to English.

 

Police reports that are not available unless you are in country to get them, are simply NOT required.  If it IS available but difficult, then it IS available.  Available = required.  It really is that simple.

If available then required, OK. But it is not available to us since one has to pick it up in person and my wife is not there (Mex) because she lives in Canada, and can't go there either because of finances and her work obligations in Canada. Her elderly mum can't do it because she is elderly and can't travel hours over land to get it. Would you agree these reasons are valid?If available then required, OK.  Montreal requires all documents to be in English even though French is an official Canadian language.

Only if it says Police Records Not available/required in the “reciprocity by country”online, then it’s not needed, otherwise there is no excuse. The reasons you mentiobed could be valid to you but the COs won’t buy that.

Hi,

 

Some of these things are now out of context. We DO have a police record from Mexico, just not from every state. I believe though that this is fine since it doesn't say anywhere that you need to show police certificates per state. It only says police record for country you lived in for 12 mo or more. So I hope we are good.

Hey all,

 

Just an update. I called the NVC and the guy on the other end was really nice. He said you don't (ever) need a police record from more than 1 Mexican state cause it gets queried from the same system/database, no matter which state you get it from! So it's all the same anyways. That's awesome!
