K1s are able to get their SSN, before or after getting married - from the day they land, to about two weeks before their i-94 expiration date.

Ok well you learn something new everyday then...maybe it's just the ignorance of SSA officers. I've often read they don't realize K1's are allowed SSNs.

And maybe it is complete bull. I'm just passing on what all other members have told me and everything I've read. Apply for SSN about two weeks after arrival, get married, then apply for AOS. Sorry if what I said was interpreted as getting married makes you a permanent resident...if only it were that easy.

No need to apologize. We just sharing information and experience. I'm not attacking you, just pointing out misinformation.

You said: "your status isn't a fiance anymore"... The only status that matters is your immigration status. There's only one way to understand it.

I've been in a situation when an SSA employee was staring at me saying my wife's immigration status has changed when she got married. There are just some stupid and ignorant people at SSA. Others are intelligent and helpful.

Marriage DOES NOT change your immigration status.

Yeah, I understand that. Sorry I guess the way I worded it came out wrong. I've just read horror stories of couples not being allowed SSNs until they get their greencard...and then that couple I spoke with they had actually given up on getting it and was convinced they would be waiting months. It's only really sad....you need that number for several things not just working but I guess in their eyes that's all they're worried about someone attempting to work illegally. And I wasn't meaning to sound rude or know it allish. I honestly love getting feed back and learning new stuff about immigration that can help me and my fiance as well. It's very appreciated.

I appreciate that :)

Some people on here are extremely rude and I don't understand it....we're all here to help each other.

There's so many times when me or my fiance read something scary and have no answers. I'm like hold on babe let me ask on VJ. They're so helpful most of the time.

Well, I'm here just to bark at people after a long day at work. Nothing personal. :diablo:

You were suppose to apply before getting married. You entered on a fiance visa if you go after you're married your status isn't a fiance anymore. I spoke with a couple on facebook whose husband was from the UK as well and that's where they messed up too. They were told they couldn't get it until adjustment of status.

Before or after marriage is fine. The couple on Facebook happened to get an untrained social security employee who gave them incorrect information. I have read of several who were told they became a K3 when they married so not eligible. Nope a K1 visa holder can not suddenly become a K3....ever.

It is less hassle to go before marriage in case one gets one of those misinformed SSA employees.  Next best option is go apply as a K1 in the exact name on the I-94 and skip discussion of marriage and name change. Get the SSN and get out. If you are told anything differently, politely ask to speak with a supervisor.

Why don’t you go and try to get one in your maiden name?  It shouldn’t be that hard. Give it a try and let us know how it turns out.

That's what we did for my wife and it was a lot easier.

I second you...it was way easier than I tought it would be...I sent my AOS alication using my husband name without having any document with his name on it when time came, EAD came with married name on it and I just went to SS and DMV with not even a question about my name. It was way harder for me to change my name on my coutry of citizenship.

You should try the Philippines sometime you almost need a booklet to do a Report Of Marriage in order to change the name in your passport. It is so ridiculous to say the least.

Hello All,

So today I went to my local social security office to apply for social security.

Ive been in the country 28 days, we got married on the 14th May (we have our wedding certificate) and are about to adjust status.(applications being completed as we speak)

the lady in the social security stated that I cannot apply for social security until we’ve adjusted status (which can take up to 10 months maybe more)????

With all the research I’ve never heard of this happening and am frustrated now that I still can’t apply for a bank account or to get my drivers license.

Does anyone anyone know why this is? I have a valid I-94.

You can open a bank account with just a passport, I have done that. Foreign nationals open accounts all the time.  To get a DL you have to have an I-94 that shows you will be in the USA for 180 or more ( If yours states 90 days then it's not valid for a DL) days or you need proof that your AOS application has been accepted ( hard copy of NOA).
