Just apply in your maiden name first. The reason they won't issue you one in your married name is because your married name doesn't match the records in the DHS base for now. In all systems you are still Kate -maiden name- and not Kate -married name- as you haven't succesfully adjusted yet. 

I get that but to say I’m using a name which I’m not is not honest.

the AOS document let’s me tick a box for social security, has anyone else gone this route as oppose to the direct route? 

Will it mean I get a social security in the same time as the normal route or will I have to wait until the adjustment is approved?

I just explained to you why you cannot use your married name YET. 

Your married name does not match the DHS system records YET so for now, you cannot apply DIRECTLY with your married name. It has to be in your maiden name as that name matches the records when they have to do a mandatory verification of your status. After receiving your SSN card in the mail with your maiden name, it is perfectly fine

If you wish to apply in your married name directly, I'd suggest waiting for your EAD to be approved and take that to the SSA office.

It's however you want to make life in the US easier.

Isn't your passport still in your maiden name? It's the same situation.

How is it fraud? You are applying for a document in the name they are permitted to issue it in. It doesn't mean you are claiming to be somebody who you are not.

You were suppose to apply before getting married. You entered on a fiance visa if you go after you're married your status isn't a fiance anymore. I spoke with a couple on facebook whose husband was from the UK as well and that's where they messed up too. They were told they couldn't get it until adjustment of status.

 

I'm sorry this happened to you...it really messes up plans to work before AOS. I honestly didn't know that either until I spoke to that couple.

I agree with dutchster, you still have the chance to apply for social security with you maiden name. Passport and I-94 should be sufficient for the social security. Other options would be getting an ITIN for the mean time and openning a bank account as a foreigner since your status hasn't been adjusted in the system still. 

 

That's what we did first thing in the morning before we did anything under the K-1. Get Social security FIRST. My wife decided not to change her last name which is not a problem. On the contrary, it's a hassle for most most Eastern european countries that go by the russian method of having to be in the birth country to get their national passport updated. At least Ukraine is like that.

Not all K-1 visa holders understands they are allowed to get a SSN before their 90 days are up. Married or not, you can still apply for one as long as it's within time frame and it's in the name that's on the passport you provide and the name you entered under. Everyone has to go through verification, hence why you cannot apply in your married name directly. 

Just always make sure you apply at least two weeks before the I-94 expires as they won't issue one closer to the expiration date as verification can take up to 14 days.

Sorry, partner, but that's bull. Your immigration status does NOT change until USCIS makes that change. SSA employees are ignorant and have no idea how immigration works. 

If you entered on K1 visa your status is K1 until you become a permanent resident.

Go back to the Social security office or even a different one. Apply in your maiden name as a K1 entrant. Do not mention marriage or anything else. Take I-94 and your passport.  USCIS has admitted you under your visa name/passport name. That is the name your first SSN will be under. Use the number anywhere needed. Worry about the name on the card later.  

 

You may use your married name daily as you like despite Social Security having you under maiden name. Apply for your adjustment of status in your Married name.

You obviously misunderstood what I was saying. I am under no conception that getting married automatically changes your status. What I was saying is entering on a fiance visa means you are unmarried not that it changes your status as far as immigration.

And maybe it is complete bull. I'm just passing on what all other members have told me and everything I've read. Apply for SSN about two weeks after arrival, get married, then apply for AOS. Sorry if what I said was interpreted as getting married makes you a permanent resident...if only it were that easy.

You said: "your status isn't a fiance anymore"... The only status that matters is your immigration status. There's only one way to understand it.

I've been in a situation when an SSA employee was staring at me saying my wife's immigration status has changed when she got married. There are just some stupid and ignorant people at SSA. Others are intelligent and helpful.

Marriage DOES NOT change your immigration status.
