Canadian Husband able to visit me in US?

Hi everyone!

 

So I tried to go through the other forum that talks about people able to visit while their I-130 is in process but 60 pages was overwhelming and I wanted to make sure we got updated information. I do apologize if this question has already been answered. My husband is in Canada waiting out the process that we filed in August last year. We are now in the NVC process and getting those documents. I got a permanent resident card for Canada two years ago to live with him and during the last couple months of that process, I came over and said I was visiting him and waited out the process there. He was wondering if he could do the same but is terrified of getting in trouble or something. Could he visit and if so, how long? Thank you for any advice!

Every time he enters he will have to prove his ties to Canada that show he is not trying to immigrate.  Can he come over and stay with you for a couple of months, sure, if his job allows for it and he does not intend to stay during that visit for longer than allowed.  You also have to keep in mind the rule of thumb "longer outside the US than inside during any 12 month period".  He will also have to go back to the final interview at the consulate when that time comes.

Yes, he can visit, and for up to 6 months. (I know this from experience, as I am Canadian.) As long as he has proof that he's not trying to stay, he will be fine. If he has a return ticket, a letter from his employer, or anything that shows his ties to Canada, he should not have any problems. ALSO, it definitely helps if he has his immigration papers on him to show the boarder patrol that he is in the process and he's doing it the right way. So, if he has his notices of action and other paperwork that he has filed, make sure he has that on hand when crossing the boarder.
