Hello,

I am US citizen, married and no children. I only have one sister who is around 40 years old, married and pregnant her first child or more likely her one and only child.

Can I sponsor my sister, her husband and the child when they baby was born. I do understand that bringing sibling to United States will take like 17-18 years or more than that but can I do that?

If I can do that, when the paper works are in process, can they or can one of them can visit United States for a few weeks?

Thank you.

Hi,

Welcome to the forum.

Yes, you can certainly petition for your sister and her family. You should start the process started as soon as you can to get them in queue. You are correct that the time it takes is 15+ years and growing. Certain countries like India and Mexico it actually takes 20+ years. The only thing you should watch out for is the age of her child(ren) because the process is so long they could age out. But if she is pregnant now and you file right away that may not happen.

Your sister and her family can certainly visit. The problem is there is no guarantee that they will get a visitor visa. They will need to show strong ties to their home country in order to get a visitor visa to the US. You can't sponsor a visitor visa for them.

If they are able to obtain a B2, then do not let them overstay their allotted time.

First off what country is this for?

Yes, you can sponsor them since you will be the petitioner for them. After you submit the application they can come and visit if they are approved for tourist visas.

You file for your Sister, any eligible dependents come into it much much later, when you are waiting decades best to file and forget it and see what the situation is when the visa number is current, a lot can change.

Thank you so much for your replies. That helps me a lot. I will file as soon as the child was born healthy and has a passport. For the visit during the petition process, I am not sure will they(or just one person) want or will get the visa. Thanks again.

Why are you waiting for the birth of the child?

Since the process will take a long time, my sister and her husband want to move all together or if not, they can stay in backhome happily. Or just visit when they can get tourist visa, money and time. Should I start the petition for my sister and her husband first? Then, put the name of the child? My sister is just pregnant and will take a few months till the birth of the child and will take some more months to let the child get passport. I actually start thinking about this and haven't read anything or haven't asked anyone yet but here only. Thank you.
