Hello

 

im divorced, remarried and have kids with the ex-husband. He's German and we have joint custody. (well, I have financial, school and medical custody alone). He is not moving to the US with us. He has given his permission vocally that the kids can move to the US with me and my husband. It's 4 kids of whom 2 will be over 18 at the date we're moving. .

He wants to sign a POA so that I can make any decision regarding the kids over there myself since he won't be physically around.

 

- what POA do I need exactly (called German lawyer, he isn't sure what POA would be accepted in the US)

- does it have to be notarised

-do I need that for the DCF appointment already or later on only

Basically a POA and a written document just explaining what's going on. The document can say that he is giving you sole authority to take the kids to the USA for immigration purposes and that he signs over any kind of financial, school, or medical decisions over to you. This only pertains to the children younger than 18 years of age.

 

This does need to be signed by him and notarized. Bring it to the interview because it may or may not be asked for at the interview. So it's better to have it and not need it, than need it and not have it.
