Hello VJ,

 

Recently, my wife who is a U.S. citizen petitioned for her mother and father to come live in the United States.  Their petition was approved and they're coming to the United States in a few weeks.  My wife still have a younger sibling who is 17 years old.  When their mother and father come to the United States and get their Permanent Resident Card.  What form do they fill out to petition their son?  How long will this process take?

Basically it is the same process as you did for your Parents and about 2 years.

Thank you for the response.  Will my mother-in-law be filing form I-130?  I mentioned that their son is 17-years old.  Do we have to be worried about him aging out and being over 21-years old?

Either can file, or both.

 

I doubt he would age out but there are no certainties with Immigration they can file as soon as they get here. Do not need the physical card.
