I will soon move to the U.S. on H1B and considering to apply for adjustment of status right away, any comment on this? My EB2-NIW case has been documentarily complete just 2 months ago, and I feel like AOS sounds like a more solid plan.

Might make better sense for you given DQ was just 2 months ago. Just be prepared for either outcome and try not to regret just in case MTL all of a sudden (highly unlikely though) starts flushing out EBs like there’s no tomorrow (like they did with IR earlier and now with FB). Just back yourself and trust your decisions, the good thing is you’ll be in the US anyway so that’s definitely great! In my case, DQ is June 2020 so I believe I’m close and my lawyers were unable to provide a good range for AOS (I’ve heard anything from 14 months to 27 months) so I’m planning on staying the course for now. All the best!

I'm on the same boat. My DQ date is October 2021. Already in the US on H1b but I can't file AOS until my wife moves here from Canada. Its a tough call. I just wish Montreal would speed things up but as the previous poster mentioned, it doesn't look like that is going to happen.

As another solution, do you think we can get TN Visa while waiting for interview?

I have heard from my attorney that when you renew your H1-B work permit while your immigrant-visa is pending at NVC, you only get 1-year renewal, not the regular 3-year work-permit. Is that right? Anyone has any experience on this? Thanks!

It's a non-immigrant visa, and one has demonstrated clear immigrant intent - will be tricky. Entering on TN with immigrant intent and filing AOS might be fraud.

Maybe I had to explain my situation better.

I currently have TN visa and working for a US firm remotely from Canada. My issue is that my TN visa is expiring in October. I have no intent to change status to AOS and do not want to enter US, just want to be able to continue working remotely.

Do you know if officer at border will be able to see that I applied for green card and deny TN visa renewal? If yes and explain my situation and do not enter US would that help?

I see. It is a different situation since you already have the TN. I don't know the answer to your question. Wish you the best of luck.

@David San I work remotely for a US company.  You do not need a visa to work remotely for a US company as long as you do not travel to the US for work purposes.

Thanks @F2J_March Really weird timing this month, will have to wait for a bit more to even try and make sense of this (or maybe not).

Side note to all: Looks like something is messed up on the Google sheet. I went in to take a look and couldn’t find my own row and I’m pretty sure some others in April and June are missing. I’m not able to get to my personal laptop until end of day and am not able to check for options to restore on my phone. Can anyone take a look? Hope no one deleted records, that’s our only way to track here! Thanks.

yes, you are right. It looks like someone on May 10th accidently deleted my row as well and other folks DQ dates looked off too. I've restored it to an older version from May 10th.  Can few folks take a look at the spreadsheet and verify that I restored it to the right version?

Here is the link to the EB tracker spreadsheet:

@3LabMom, thanks for sharing, how does it work? don't you need to have valid SSN?

I work as an independent contractor...less hassle for them and me.  I believe you just need to fill out a WEN-8 (not sure if that's the right name), but it's just so no tax is withheld and you pay the CRA.

Thanks so much @topman! Looks great to me.That’s how I remember it, thanks!

That happened a couple of months ago, where people were deleted, but were able to be restored.

i also have a couple of questions, as I have been reviewing the common questions most people get asked at the interview:

1.  What countries have you visited in the last 5 years-Is that from the present, or was it the last five countries when we filled out the DS260, which was almost three years ago?

2.  Do they still ask -When were your last five visits to the US?  They would already know that info from the I94 website.

3.  Do the applicant and spouse get interviewed separately or do they both go up to wickets together?

Sorry, I will probably have more questions as we get closer, but for now I'm only stressing over the Interview and the what if's!!!!!!

1. From present

2. I wasn’t asked that. What I was asked was what was your longest stay in the US. It is irrelevant that they already have the info from I-94. They have most of the other info too. They ask to see how you answer, to judge whether there is any misrepresentation/ fraud etc.

3. Don’t know the answer to this, as my category is different and spouse wasn’t present at the interview (I am guessing it is done together).
