I don’t think EB category needs Affidavit of Support, unless it’s a relative filing for the petition or the applicant has 5% or more ownership in the business that filed the petition. Please see below excerpt:

Who Needs an Affidavit of Support?

This form is legally required for many family-based and some employment-based immigrants to show they will have adequate means of support after immigration to the United States. Generally, the following intending immigrants need an Affidavit of Support:

  • Applicants for family-based immigrant visas, including certain orphans.
  • Applicants for employment-based immigrant visas where a relative filed the immigrant visa petition or has a five percent or greater ownership interest in the business that filed the petition

thanks @VA21202, in this case how NVC is making sure that petitioner still want to support the applicant?

like @VA21202 said, my understanding is that EB petitioners are not "financially supporting" the applicants except when the petitioners own a big stake in the firm themselves

I am thinking that I may have gotten the IL because I wrote to the consulate after the last consular update (May 4th, 2022) where they indicated that they were caught up to March, 2020.  I asked if they had inadvertently missed me, because our date was earlier in March.  Plus my interview isn't until the end of June, and they normally don't give you six weeks notice. I'm hoping they will send out a lot of IL letters for July.

Congrats and good luck on your interview! BTW, since your interview on the end of June, does it mean there will be no more ILs for EB in June? Fingers crossed.

sorry, by support I don't mean financially, I mean if petitioner still want the applicant to work for them.

They want to see a letter from the employer stating that the job is still available and that the candidate is still their choice.

I'm repeating what our lawyer told us a few months ago.

Praying you hear soon!

🙏🙏 REALLY hoping we hear soon so we can get settled in time for the new school year.  I had really hoped for a May interview - July will be cutting it close.  Everything is so much more complicated with two little kids!

Might be worth sending an email similar to Sorrel’s? After all you are March DQ too!

Yes I think that is a good idea.  I quoted the May 4th, update wherein they said employment..... was to the end of March.

Give them your date and ask if it was an oversight that you might have been inadvertently missed.  I sent the email on May 5th, and received my IL this morning, five days later.  You should definitely give it a try.  Good luck!

Any update on your expedite request? Seems odd to approve your request, yet leave you hanging.

They will send you a robo reply first, saying that they will are back logged and will deal with the emails in the order received.  But hopefully next week you will get your IL.   Then you can start planning the rest of your life!  We have all been on hold for the last number of years!

Thanks @F2J_March Really weird timing this month, will have to wait for a bit more to even try and make sense of this (or maybe not).

Side note to all: Looks like something is messed up on the Google sheet. I went in to take a look and couldn’t find my own row and I’m pretty sure some others in April and June are missing. I’m not able to get to my personal laptop until end of day and am not able to check for options to restore on my phone. Can anyone take a look? Hope no one deleted records, that’s our only way to track here! Thanks.
