Got 10 years Green Card-Removing of Conditions

Hello team, 

I have moved to US in March 2018 and got 10 years green card with Category IR-1 as my wife is US Citzen. Now I want to ask following question:

1- With IR-1 green card should I have to remove any conditions or not?

2-With IR-1 green card can I go back to my home country and have to come back within one year?

3- My wife is US Citizen, I can apply for Naturalization after three years?

Please reply to all above questions.

1. No ROC is required for a properly-issued 10 year green card holder.
2. All LPRs must maintain permanent residence within the US. There is a presumption of abandoning residency if you are outside the US for 1 year or longer.
3. Yes, you can apply 3 years - 90 days from the date that you became an LPR, assuming you meet the other requirements.

When you recieved your 10 year green card, were you married for more than 2 years? This is the question that answers if you need to file for ROC or not. 

 

In very rare cases, USCIS makes a mistake and issues a 10 year green card for marriages younger than 2 years. Just make sure you’re not in this rare case and you should be good to go.
