Hello guys,

I need help and advice. I came to the US in 2014, we got married with my husband and I received my first Green Card for 2 years, before it expired we applied for my second Green Card, I had my fingerprints done and then we were told to wait for a letter invitation for our interview but meanwhile my husband passed away. Needless to say how hard everything is emotionally because when everything happened I had a 2 yo and was 30 weeks pregnant. Our second daughter was born a week ago and I am still in the process of taking care of all the paperwork and I called the USCIS told them what happened and they said I need to write an explanation letter about what happened plus my husband's death certificate.

I would like to know if anybody went through anything like that. Are there any examples of the explanation letter or just write what happened and it will be enough? I am so confused and need help and advice.

Thank you very much in advance!

I am sorry for your loss.

I moved your thread over to the Removing Conditions forum because it is better suited for your question.

I am so sorry.

The correct course of action would be to write a letter giving your name, alien number, I-751 application number, and stating what happened, and that you wish to change your filing from a joint filing to a waiver filing based on the death of your US citizen spouse. You should enclose a certified copy of your husband's death certificate to the letter, and send it to wherever your I-751 is currently being processed. You can also make an Infopass appointment at your closest local office and deliver it by hand to a USCIS officer there instead, if you wish.
