Hi,

i need some help regarding i-30 for wife and kids.My History is that i got married over the phone after 5 days   to  reaching in USA and registered our Nikah  after 4 days.now i'll apply for citizenship  in 2019.Some one told  me that uscis is not accepting Marriage cetificate if Nikaha done over the phone, Is that true?

USCIS will not accept a proxy marriage unless it has been consummated afterwards.

"(A) Proxy Marriages .

Section 101(a)(35) of the Act provides that the term "spouse", "wife", or "husband" does not include a spouse, wife, or husband by reason of any marriage ceremony where the contracting parties thereto are not physically present in the presence of each other, unless the marriage has been consummated. (Note: Consummation of a marriage can only occur after the ceremony, there is no such thing as “pre-consummation” of a marriage.) "

After 1 year of Registering our Marriage i went back to to my country to get married officialy.But Marriage certificate  registeration date is same old one

Ah, okay. So then the proxy marriage sounds like it would meet the criteria here (assuming you met face to face at some point on the trip).

 

Unfortunately, I don't know the specifics on the documentation for an Islamic marriage so I can't help you there. Best wishes.
