Hi. I am a pakistani and canadian who moved to usa on CR1 in 2016. I unfortunately forgot to file i-751 due to constant travelling, family and career issues. While I was crossing border after visiting my parents in canada I was stopped at border. My green card was taken and I was put in removal proceedings. I am on parole in USA at the moment and have to wait for immigration hearing. I have a 1 yr old child and I was set to start medical residency in a month. This is an extremely distressful situation. We have a lawyer and we are filing the i751 petition now with explanation. What else can we do? Please suggest.

Follow the guidance and instructions of your lawyer. By all means do NOT miss any court hearings. You mentioned you are filing ROC now so that is good. Gather as much evidence as possible of your marriage being bonafide. Not much more you can do other than stay out of trouble, obviously.

 

Be advised that you will not be traveling for a long while. This needs to be resolved first. You may still be able to start your residency as long as it is in the US.

The IJ will review the case. Beyond that, prepare to argue your case with your lawyer. Be sure to provide plenty o evidence of a bona fide marriage, and an argument for why you failed to file on time.

 

The doctor component, residency, etc. will have no impact on your case.

I agree with above.  Make sure you do NOT allow " traveling, and career issues" take priority.  This is serious, and you will need expert help.  Good luck!!

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I would have thought a good lawyer can resolve the issue, if you are not comfortable with your Lawyer find one with whom you are.
