So me and my husband were married in my country. I came to the usa In May 2017. We only live together until November 2017. We had so many problems in the marriage. He wanted to work things out, but I stop talking to my spouse. I wouldn't respond to any of the messages he would send. He has been trying to located me to file for a divorce. However I moved to another state without telling him. My two year conditional green card will expire in a few months. My questions is if my spouse divorce me will i have a hard time trying to stay in the USA? I no we have to show proof that we were in a bona fide marriage but the problems is, we have no joint accounts together, or anything together. What will happened? Has anyone ever been denied and sen r back to there home country?

Guys, imagine lawyers answered like most of you did? They would lose everyone too. 

 

Be neutral, just because something didnt add up yet, dont start throwing around accusations of sham marriage, marriage didnt mean much to you etc

 

ask questions and see how they answer, could be a really true but confusing situation, could be language barrier, so many love to jump the gun here quick and these people run away where it would have been beneficial for everyone including those who will frequent this forum in the future to know how a “confusing” “not normal” case ends up and why?   

 

Yesterday, I was reading a thread of a highly respected memeber with so many upvotes who gave so many of his opinions and accusations about a person’s situation including life changing and FALSE info. 

 

He told a memeber that once your I751 is denied, you are out of status, this is not true at all and he could have ruined the person’s life up to suicide with giving him such wrong info  

 

Always include thats its your opinion when answering a question and mainly answer or brainstorm with the group, stop accusing people out of your personal frustration, there is a whole gov agency that takes care of that, its not your job to guess whats a sham without someone’s file infront of you and the credentials to adjust

Look no one knows what USCIS threatshold for removal is, and most importantly no one knows the threashold of what a judge is (judges dont play with threasholds, they have to make a judgment based on facts without a reasonable doubt)

 

If you have zero evidence, you are going to need a competent lawyer thats specializes in writing, you will need to write letters on letters explaining everything that happened in your journey, why you left him? Did you have money issues that side tracked you from getting a divorce etc etc. you need to be truthful about what happened. If they cross the info and they find a lie then your immigration journey is over (still not quit as simple as GOTCHA)

 

but now, you cant file the I751 jointly or with a waiver.

 

Well technically you can file in both but You need to clear up the marriage first. If you file jointly, you need to be in contact with your husband and he needs to join you if you get an interview. 

 

If you file a joint waiver, you need to file for divorce and have the divorce finalized with a decree asap.

Bold 1. How do you know and why don’t you want to divorce him?

Bold 2. Someone has tried to salvage their marriage to you, even tried to locate you to talk, but you’ve ignored him until ROC and all you care about is the GC. 

Anyway, is there a reason why you don’t want to be in contact/ be with him? I ask this because a while back, someone posted here asking about the best way/ time to divorce their American spouse so that he/ she can bring over their other spouse from abroad.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.
