Hi there!

Got my head spinning bout the mistakes we had in the 129f form. Hope someone can help me out!

 

The problem is all about my Fiancès name is incomplete in the form. Example his real name is (Juan Santos Madrid) which is his given name his dad last name and his mom's maiden name.( Take note he is Latino) mostly of them used their moms maiden name. 

 

But he only put (Juan Santos) in the 129f form. 

 

What's the best to do about it? Do we need to call USCIS that there's a little mistake in the paper? Or is it fine since we provided his Birth certificate with his Full name  (JUAN SANTOS MADRID)

My best guess ... you might gt an RFE for it, you might not.

 

I'm not sure you can call with a correction like that. Someone may know for sure though. Have you received the NOA1 yet?

i 485, 130, EAD and AP

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

 

ROC

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

Yep we received our noa1 already last march 15. And in the paper it only says Juan Santos tho.ugh

He is the beneficiary, right? If you have a case number assigned you can submit a request with USCIS to change that. I've gone through the same with AOS, it should be the same. Try doing it online, mail and calling though, because i don't know which one worked for me (i had 4 requests). Online you can try here: https://egov.uscis.gov/e-request/displayTypoForm.do mention the form, part, page and item number (ex I-129F, part 2, page 2, item 3a. Last Name) and write what that field should have contained (i imagine you left it empty, right?). Good luck!

Worst case is you get an RFE for which you would have to make the change to the form and resubmit.

 

He'll have things like Birth Certificate / passport page that will verify whichever name he chooses. Typically if the name differs, you would have to show proof to support that different name, or change the form to reflect the correct name.

I doubt you'll get a RFE for this, since they don't ask for proof of the beneficiary's identity until the interview stage. That's when you would have problems, because Juan Santos and Juan Santos Madrid are not the same person. 

 

Like someone said above, call USCIS and get this fixed before your petition gets approved.
