Hello everyone, my petitioner and I are now preparing all documents for K1-visa. My petitioner's first name is "Russell" and an American citizen. But when we got his birth certificate, we realized his name on the certificate is "Russel". Actually he knew it but he believes it is no problem because he has lived so far using his name "Russell."  That freaked me out!! His name on the social security, driver's license etc are all "Russell."  He has never changed his name from "Russel" to "Russell."  That means he has a different name and he should put "Russel" on page1 of I-129F "other names used?" or he needs a regal action? Anyone knows what we should do?

As long as he doesn't submit the birth certificate, it wont matter.

 

How is it spelled on his passport?

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

If he submits the passport or the birth certificate it doesnt matter which- the name must match the document and the application. Enter the other variation under other names used. 

Thank you for your reply. He doesn't have a passport so we are going to submit his birth certificate that "Russel" on. It sounds very strange for me that the spellings between birth certificate and others are different. But your advise is helpful. Thank you again.
