Timeline

My spouse has applied for my CR 1/IR 1 for the past 6 months and we still waiting for the approval of my i130. I know that as soon as its approved, it will move to NVC and we shall need to file the affidavit of support among other documents. 

she has filed for her tax return for this year and it's very good and I believe that is what we shall use for the affidavit of support. My questions are

1. Is she going to send the tax return to me as part of the documents I will take along for my interview?

2. And if so and It happened I don't get interview date before the next tax return which will be April 2019, will I still go with the former one used to file for the affidavit of support or the new one for the year of the interview?

You shouldn't need the document at the time of the interview. You will send it with your application to the NVC. The NVC forwards all of the documents they have to the embassy when you interview.

 

If you want to bring a copy of everything that is fine. I know my wife did, but they didn't look at any of it.

 

As for the next tax return - If she files her 2018 taxes before your interview, you can bring a copy of whatever you have from that to the interview but again it shouldn't be necessary. It also wouldn't be especially helpful if it was just a copy of the tax return she filled out (or her accountant did). What they prefer is the actual receipt from the IRS showing that it was filled correctly/approved. I could write anything I wanted on my tax form and then show it to the NVC. They want to see evidence of the completed tax return (You can get a receipt from the IRS).

 

It's been awhile now but I believe we included a copy of my W-2 for the affidavit of support as well.

There are two seperate requirements, to file taxes and to meet the income/capital requirements.

 

I will take tax as done and sounds like income will be used so she will need to evidence this by supplying evidence to support her income, as you say this is sometime away.

You will need to take your taxes with you to the interview..Nigerian Embassy is quite different than other Embassies...My husband taken my last 3 years of Tax transcripts and they did retrieve them from him..Although those docs will be sent to NVC then forward to the embassy, they wanted the originals..

Correct.  Copies are sent to NVC, but all that can be carried to the interview are also copies, when it comes to tax returns.  What the US (not Nigerian) Embassy Consular Officer will need that is "original" is the original signed Affidavit of Support.

Facts are cheap...knowing how to use them is precious...
