Hello Friends.

 

Who can confirm or explain in a better way?

 

A petition for K2 visa, can only be done at the time K1 is filled!

 

We cant not apply for a K2 months while K1 is in process nor after K1 visa was issued, it is a single shoot to include the child (same package) when we apply for K1.

 

If we miss that opportunity, we must file for other type of visa to bring the child to follow the mother.

 

Just looking for confirmation on what I understood. :D

Hi There,

 

I believe this is incorrect.  As long as you listed the child on the original petition you can apply for a K2 visa at the same time as your fiancé applies for her K1.  At least this is my conclusion from my research.

No not too late. If the child is listed already on the forms where it asks to list children then you are all set. No papers get filled out for the child until medical and interview stage.

Yes, At the same time, but what if we want to apply 9 months later? Don't we have to file a I129F for fiance and another I129F for each child listed on fiances form? Pay the fee for Fiance and the same fee for each child?

Are you sure, I understood that we need to file a I129F for each child, and pay the $535 fee for each child.

 

Ex.

Fiance + 1 son

  • One I129F form for the fiance listing the kid
  • One I129F form for the kid
  • One $535 fee for the fiance
  • One $535 fee for the kid
  • and all the supporting docs for both.

Ami getting this wrong ?

I think At 9 months you would have two options:

 

1. Bring the child in as your stepson which is the I-130

2. Have your spouse bring the child after she gets her greencard

 

if you can get everything squared away within a year (visa in hand) follow to join K2 maybe an option.

 

Please verify all my answers because this is just my own research.

You do not file the I-129F for the child. Only your Fiance. 

Once the petition gets approved, they will do the medicals, and interview. Pay visa fees and medical for both(not sure what the fees is).  That is much later in the game.

I think you only need to pay the 129F once.  The K2 and K1 visas ds-160 i believe, will need ti be paid for each.  Also medical and whatever else.  I am assuming the child is and will be under 18.

If you want to bring the child 9 months after mom gets the visa. Then when you're ready you do the Follow to join option. This is only good for 1 yr after mom gets her visa approved. To do that she would just tick the follow to join box when she completes the forms for her interview. 

 

Now just to make sure you know. If you go with both getting the visa at the same time you can wait up to 6 months to bring the child. The visa is good for 6 months from the medical exam.

when and how do  I apply for K2? can that be a process done after she get her K1 ?

I see, so mom brings her passport and medical, get her visa, than 9 months after schedule another interview to bring kid passport and medical ? or mom have to bring hers and kid passport and medical, and by choosing 'follow to join' option her kid will have a year from medical to travel ?

Yes if you want the child to come 6 months later. Mom, child do medical and interview at the same time. That gives them 6 months to use the visa from Medical. Now there have been a few times where that time was shorter so always double check the visa before waiting until the last minute. 

 

If you want the child to wait 9 months after mom goes for her Medical and interview then Mom checks the follow to join box. The child would do medical and interview later.  Just make sure you plan to get everything done within a year of mom's visa. Don't wait for the last minute in case things slow down.  The child's interview needs to be before the 1 yr time is up.

 

Just to add it is a bit of a pain to have the child wait and figure out how to get them to the interview and how to get them to the US after. Plus all the expenses of the extra travel. If things also keep going slow to get the AP mom may not be able to go do these things. She will need to depend on others.

Hi. You only put the names the children under the inmigrations conditions ( under 21 years old and no married) on the form I-129f and then if that process is approved in USA those children can apply in the embassy the country your fiancee for a K2 visa. The K2 visas it depend on the K1 visa, not exceptions. On the other hand, you only pay an unique fee for that form for your fiancee now is $535 UDS later when your fiancee has her interview in the embassy you will pay for each visa apart and fill a form DS160 for each applicant and all the other requeriments...So, if you added the names your future stepchildren in the form I129f, great. They can apply for K2 visa the same time your fiancee has her visa interview in the embassy. Success!

You had the best explanation for this! Thank you,  Let's complicate the matter here.... lets say,  mom is here,  working... no vacation time, can the husband (step-dad to be)  go to philippines to help grandma and 9 year old kid on interview, or K1 recipient needs to be present on interview ? What about POE? K1 recipend (resident by then)  needs to be present?

yes, what I am trying to understand is how long to I have to apply to K2 and how do I do it...
