FILING FOR BROTHERS AND PARENTS AS A US CITIZEN

Hello Folks,

 

Just one question here as I am going to petition for my parents to come to the US and my little two brothers who are currently 18 and 19 years old.

 

Should I file separately for my siblings or they could be included under either parent, on form I-130? Also, wouldn't it be wiser to wait until my parents get their Green Cards and then file for them as this will bring my brothers under a category than has less waiting time.

 

Your advise would be appreciated!

  Parents will take about 24 months and you need a separate petition for each.  Siblings are over 14 years of wait time and the category may not stay. In 2 years your older sibling will be 21 and your parents could petition an unmarried adult child but that wait is close to a decade and also on the immigration chopping block.   The younger one might make it before they age out and only have a couple years wait if petitioned by your parents.  

This will not be over quickly. You will not enjoy this.

Thank you for your brief answer.

Now, it is possible that I apply for my brothers under the Siblings category and then when my parents get their green cards, my brothers could be switched over to the category for sons and daughters of LPR. Or it better to wait until my parents get their green cards and then apply for them because I am not sure that if I applied for my brothers, it would be possible for them to be switched to a different category, under my parents. I hope I explained my question well.

  No you can't pass a petition to someone with a shorter wait.  Some people file for siblings to avoid the possibility of the petitioning parent passing and the sibling being stranded.  If an event causes a petitioner to have a shorter category available that works such as your parents becoming citizens and children of USC's have a shorter wait than LPR's

This will not be over quickly. You will not enjoy this.
