Bringing mother & step-father to the US

My biological mom is married to my step-dad who has never adopted me in my home country. (My biological father passed away).

With mother it’s my understanding that I just file I-130 and start the process from there. 

Can I also “sponsor” my step dad and file I-130 for both of them at the same time since they are married? Would they just need to bring a marriage license? Or would I have to start the process for my mom and then she needs to file for my step-dad?

She will have to file for him separately. How long has he been your step father by the way?

You can only apply for your stepfather if your mother married him before you turned 18 

All the documents needed are clearly stated in the I130 instructions.

You must be a USC to petition for your parents.  LPR cannot petition for parents. 

She married him when I was 6 years old. I’m trying to plan for the future once I become a usc

I can apply for naturalization in 5 months. Just trying to plan ahead since they would need to get started with a travel passport and depending of what route we would need to take we need to plan accordingly. Obviously it’s a bit stressful for them if my mom would have to come by herself and he would need to wait who knows how many years. Unless I can apply for both of them at the same time.

Yeah separate petitions, im glad it was prior to 18.

Yeah... that’s exactly why I am trying to figure out exactly what I need to file (or what can I file right away) before anything drastic happens. And they are getting older so this needs to be considered as soon as I get my naturalization.

The process for your parents will take 12 to 15 months from submitting the i130 to interview.. they then get 6  months from the issue date to enter then US.. make sure you understand the implications of  health insurance for them.. can be very very expensive of they are not working and getting it through employer . 

 

So I’m confused, they need to come for the interview or I go to the interview and then they get 6 months to enter?

No my mom is disabled and my step dad just has a small business that makes you just enough to pay bills. The country is in a bad place with their economy. Would that be a problem? They don’t have the funds to show that they have money or anything like that. Even for plane tickets. :( I mean I obviously need to sign affidavit of support and intent of full financial support anyway. Both my spouse and I make good money and I have great insurance I can put them on.

While you are researching the process to bring them here you should also look into the cost of health insurance.

 

Many get sticker shock or are unprepared to pay the monthly premium.
