CBP secondary inspection- wrong info in file

Hello everyone

Two years ago I been under secondary interview at CBP In Miami on wwp. At that time i was few months engaged and didnt have a proper visa so i was returned back and my WWP was denied. I did not overstayed. Now we have i-130 pending.

the cbp officer who i had interview with didnt give me any document with the interview so we requested FOIA for all filles.

1. Not interview was submitted - only summary. So does it mean that the interview isnt anywhere in my file? (They suppose to submit all docs)

2. Cbp officer written into the summary of the interview that i admitted to meet my boyfriend by this xx way. The officer knew it was my fiance (not bf) at that time and he stated falsely how i told him i met my fiance. 

3. Than there is written that i been spending 8months out of 12 in the US and found no ties to my country and i agreed that i will do proper visa whether fiance or student. (True) But than.... “she has expressed a desire to live in the us through whichever avenue is open to her”. Did he mean the fiance or student visa as i stated or did he meant like i want to be in the US in all chances? I have no idea how i would give him impression of the secOnd as I spent so many months in the us because of my fiance.

 

 the officer was right to deny my wwp. I didnt know at that time its wrong come back and forward or didnt think anout it. What i care though is as stated before. Ill have interview at the embassy next month and now i dont kmow if they will read this summary from interview and if so, how to tell them about number 2.  And what to take out of statement 3. 

 

 

any reccomendations?

Denied VWP does not have any impact on your spouse visa anyway. Just be honest about it if they ask you what happened.

 

Just curious how did you go to US on VWP when Poland isn't eligible for it. :P

01.08.2018 - RoC approved.

Will fix it! :) i filled accidently wrong country.

Glad that denied vwp does not have impact; but i worry that what is in the summary of the deniAl and the different statement “i suppose to say and swore under oath” will have impact.

Stay on or get on the truth train.  It will be what it will be.  Denied entry is not a problem.  A material misrepresentation is.  You are not real clear about whether you lied and the CBP officer says you lied.  If that's the case, you MIGHT have a problem with material misrepresentation.  If not, no worries.  Usually, there is a "code" hand written in the passport at time of denial.  Is there one?  If so, what is it EXACTLY including ( ) - etc.?

Facts are cheap...knowing how to use them is precious...

No i did not lie to the cbp officer. The problem is he written that i knew my boyfriend from Dating site that match european women with american man 🙄 but true is i met my boyfriend through a friend who i met there.  (They asked). Is this dating website bad itself?  

In passport is: refused in accordance with INA section 217 - R27044.
