Hey everyone,

 

My hubby and I received the NVC case number, paid the fees and are now filling out the necessary paperwork to it....my question now is...on the AOS form it only asks for recent tax year, which is the only one that he had a lower income than required due to going to school. He got employed directly after he finished said school and now his income for the upcoming tax year will exceed the minimum by a lot. 

Do any of you know if we still need someone to co-sponsor due to last tax year even tho we can proof current income is much higher if his VA doesn't provide the paperwork proving that he received his GI bill benefits during the school as a secondary income?

All he has to do to get his VA paperwork showing how much he was paid monthly is go to https://www.ebenefits.va.gov/ebenefits/homepage. Once he logs in he can go there to see how much he was paid monthly with the GI Bill and if he is receiving compensation pay what the amount is and his rating.

Oh we had no idea that's how easy it was to get that. Thank you for the info!!!

Once he has a basic account on there he can look up his rating if he has one, get the paperwork showing his rating and the payment amount, and he can look at the payment information to see how much they paid him and when.

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

The form asks for INFORMATION from three tax years, but requires him to send in a copy of only one.  A separate place on the form asks about his current income.  No place on the form is he asked for "current year" income.  Current income is his gross income for the next twelve calendar months based on what his "current" job is paying him.  You "qualify" as sponsor based on current income but it is STILL a judgment call based on the totality of circumstances.

 

What is missing from your summary is HOW LONG he has been working at his current job.  Knowing that will help us understand whether a "joint sponsor" is likely to be needed.

Facts are cheap...knowing how to use them is precious...

He's worked at his current job for 8 months now. (Since mid September of 2017)

Then I would be sure to have the year end pay stub, AND the most recent one with you at the interview.
