conditional/unconditional green card

Timeline

Now that we have NOA2, we are starting to believe this visa thingy might actually happen !

We intend to enter the US on November 5th when we will have been married 2 years.

I understand that at the moment, we must do all the paperwork for a CR1 - conditional resident, but the green card should be unconditional when it is actually issued.

Is it worth pointing out that we will then have been married 2 years when the immigration officer is processing me or is that all done at the USCIS and he has no facility to put a note on the file ?

I have visions of a conditional Green card arriving and a long process to correct it so I wondered if there was anything I could do to make it plain on the file...

What Dan said. If the visa is CR1 but entry is after the two year anniversary, definitely mention it at the POE, to make sure it isn't missed. The passport stamp and greencard will then both reflect ten year expiration.

Thanks for that - hopefully the USCIS computer will decide it's unconditional - if it's a manual operation then there is a good chance (knowing them) that it could come out as conditional...

I had not thought about the situation where the interview is delayed past the 2nd anniversary (quite possible) so asking for a IR1 then is a very valuable thought

Just mention to the INS officer at POE that you guys have been married for more than 2 years and therefore you should get a permanent green card by mail.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

There is no difference between the paperwork for a CR1 visa and an IR1 visa - it's the same visa, the same paperwork. Whether the CR1 designation or the IR1 designation is attached depends on the age of the marriage at the time a particular document - visa or Green card is approved.

I will mention the 2 year thing at POE but I get the impression that the officer will just shrug and the form of green card will be decided at USCIS....

My wife came here in December on her CR-1 visa. She mentioned to the POE officer that we have been married 2 years and 2 months at that time. The officer told her that since we did not live together for all of that 2 years and 2 months, she could not receive the 10-year visa.

What Is Conditional Residence?

If you have been married for less than two years when your spouse enters the United States on an immigrant visa, the permanent resident status is considered “conditional.” The immigrant visa is a CR ( conditional resident ) visa, not an IR ( immediate relative ) visa.

You and your spouse must apply together to the Department of Homeland Security's U.S. Citizenship and Immigration Services (USCIS) to remove the “condition” within the ninety days before the two year anniversary of your spouse’s entry into the United States on an immigrant visa.
