We got her SS card before we got married, so it had her widowed name.  After we got married but before AOS, we went back to get her name changed as recommended.  They refused to change until we received an EAD or GC.  I argued to no avail.  After we received the GC, SSA used her messed up name on the GC for her SS Card.  It had to match the GC.

 

As far as the DL, that has been another whole level of stupid.  She still doesn't have one.  They wouldn't do anything unless she had a EAD or GC.  Now that she has one (GC), they are now researching her status with USCIS.  They will contact us by mail once they have confirmed her status.  ('cause ya know, everyone can make GC in their basement...)

Texas needs to screw their heads back on straight, that is just crazy stupid. They let us change the SSN with the Marriage certificate and she had her State ID card also...they didn't even ask for an EAD or GC. 

 

Why the heck would they not trust the green card, I don't get it.

Technically per SSA policy you shouldn't be able to get an SSA or change the name on it between the time of marriage and getting your EAD or GC.  It's considered a "no man's land" because your status is that of "waiting."  You can argue whether that makes sense or not but it's what they go by.

That is incorrect.   Technically the I-94 is the governing document during the 90 days after arrival (need to apply for the SSN while having over 10 working days remaining on the I-94) .. and by law SSA will issue an SSN, and the marriage certificate governs the changing of the name (per state laws).   

 

I-551 is the green card, I-766 is the work authorization.

Hank, You highlight the I-94 which is issued for a lot of different visas which SSA treats accordingly.  The paragraph listed is very vague and encapsulates a lot of the SSA policies into one.  Speaking specifically about the K-1 once you get married your status changes in the eyes of SSA as I explained before.  That is why it is recommended to get your SS card before marriage or you will run into a lot of trouble getting it.  Believe you me, my wife and I found this out when we tried to get the name changed after marriage.  Luckily I (or unluckily I suppose) got to speak with someone fairly high up the food chain at SSA because I thought the same as you did.  I'm fairly confident that she didn't get her job by not knowing how things worked from A to Z.   So we just opted to check the issue a new SSA card box on the i-765 application and not bother going back to the office.  And it arrived 2 days after the EAD with the new name. :)

Thousands upon thousands have completed the SSN application after marriage & using the I-94, with my wife being one.    SSA has to issue an SSN with a valid I-94, if the idiot behind the counter refuses, then he should be turned into his superiors.  Whether SSA does this in the married name or not before issuance of the EAD or GC is a different story .. but that is easily remedied also once either of those arrive,  and you have to return there anyway to get the work limitation removed..

 

Your wife wasn't issued an SS card at your initial visit?
