hi,

well, to make it short, here is where I stand:

I am married to a US citizen, have been for 15 months. I have my temporary greencard (2-yr) as has my son from a previous relationship.

My marriage is on the verge of breaking, and we try and try to reconcile, but to no avail, it only seems to drag out the inevitable and the next fight just gets harder and harder to work past.

Anyhow, I was told last night that he has had it and wants me out. Main trouble is, I am 31 weeks pregnant.

Where do I stand?

I don't want to stay here, as I have no family, relations, nothing here... it's been pretty much him me and his Mom.

Then again my son loves it here and moving again will make it so hard on him, and he has no ties to my native country.

How bout the baby? Do I just fly out in the next few weeks whilst still pregnant? Will I have a huge custody battle awaiting me? And can I get a divorce whilst abroad?

Please help.... because crying doesnt seem to help much these days, but it's bout all I can do...

Sorry to hear about the problems you are having with your marriage. You would be better off talking to a lawyer who specializes in family laws and divorce for your questions about custody and the divorce process itself.

It's not going to be easy as you have to also consider your son, who loves it here, and your unborn child.

Firstly, I am sorry for you predicament.

Some of the things you need to consider.

1. You need a US Divorce Lawyer, divorce is governed by the State, so one locally. I would not know where to start looking, if you post which State perhaps somebody else can point you in the right direction.

2. Children adapt, I would be wary of making some uncomfortable choices purely on the basis of his current wishes.

3. You can certainly leave now and there would be nothing he could do. If the child is born in the US however it would be a very different situation. Sometimes it can be difficult to move a child out of state, never mind out of country. There could still be custody issues, but you may find it more comfortable top work within your legal system.

What has your husband said regarding your unborn child? Has he made his intentions clear....like does he care if you move home? Would he want a relationship with the child? Is he prepared to stand by you and raise your child together?

I think these questions have a great impact on what you should do. If he wants to be an active father...then you must consider staying for the sake of your unborn child.

I am sorry to hear this. Have you spoken to your husband about the future child? Is it still possible for him to talk to you about how to save your marriage? Perhaps, counseling will help.

i think rather than leaving the country why not u try to reconsile with your husbd as u told it wasnt of any use

why not just try for a marrige counselling

right now u should be strong

so tht your baby is healthy

If you have any intention of returning back to your native country then you NEED to research the Hague convention NOW, AND I MEAN NOW. DO NOT WAIT.

The Hague convention is very very scary when it comes to child custody and habitual residency. Say your child was born in the US and you lived with your husband for another six months before deciding to call it quits and return 'home'. Even if your husband verbally agreed to you leaving with the child, he can easily invoke the Hague convention and have you and the child forcefully removed and returned back to the USA until such time that the child has lived in your home country longer than he/she lived in the USA. It is a horrible horrible law which has been abused many times by disgrunted ex-partners. Mine tried it. Luckily, he waited too long for it to have any effect.

I'm sorry if I scared you but your post really brought a lump to my throat. Please contact an attorney now and ask them about your options if you have any doubts about your marriage lasting. You may save yourself a lot of heartache later.
