Hey guys, 

 

Background:

So My wife is Canadian, I'm from the USA.

We are adjusting for status based on marriage and we filed around march 1st 2018

We were sent notices of them receiving our packet + we were sent our biometrics appointment which we went to on april 12, 2018. 

However, when I checked my case status yesterday it said this:

"

Notice Was Returned To USCIS Because The Post Office Could Not Deliver It
On April 10, 2018, the Post Office returned a notice we sent you for your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number ********, because they could not deliver it. This could have a serious effect on your case. Please go to www.uscis.gov/e-request to request a copy of the notice immediately. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.""

 

I haven't checked it since around april first so I am terrified I didn't catch this earlier.  However, I contacted my attorney who said as soon as she got the update she requested more information. She told me she hasn't received a response:

I called UCIS yesterday(before I asked attorney) and they told me they do not have any indication as to what wasn't delivered. 

 

Right now I'm lost and just want to sort this out so my mind can be at ease.

 

So to sum it up:

  • We sent our packet around 3/01/2018 and they cashed the checks on 3/15/2018
  • Received notices that they received our forms around 3-20ish
  • Received our Biometrics appointment letter march 3/30/2018
  • Case updated to "Notice Was Returned To USCIS Because The Post Office Could Not Deliver It" on 4-11-2018 + attorney inquired about it
  • Went to biometrics and had no problem on 4/12/2018
  • No response from UCIS to attorney since + she called them on 5/21/2018 and confirmed with USCIS that the address they have on file is accurate and mail was received by me.

 

She said it is likely an error on their end and that we should be fine going forward.

 

I'm wondering if they couldn't deliver it because maybe it was in my wifes name and for some reason the post office wouldn't deliver it? she has my last name now, so I'm not sure why they wouldn't deliver it.

I'm hoping its just an error and won't ruin the whole process, as I couldn't imagine life without her.

 

I would just like your guys input on this. Thank you so much!

Thank you! I'm wondering if maybe the postoffice marked it as undeliverable  if it was addressed to her, if that makes sense. Do you guys know if they address it to the applicant or the petitioner. The other paperwork was addressed to me. Even so we have our joint bank statements delivered to us (addressed to both of us) so the postman should recognize it.

 

I'm going to wait for him tomorrow and talk to him. 

 

My biggest fear is that it is an RFE and due to the delay we wouldn't be able to respond to it in time. 

 

Do you know if they would add RFE to your case history? I believe the case status once said they recieved our package and sent us notices but When I check case history it doesn't mention this. I could be wrong on this though.

She seems to think it is an error/gltich.

 

On Tuesday I'm going to 

1. Confirm and add her officially to the address ( I thought she already was - she has mail delivered here - same last name etc.) + ask for names/numbers of the delivery men during april1-april10th. I asked my main guy who delivers about 5 days a week and he said it wasn't him but if it did happen it would have been one of the guys who works on his off days. 

2. Thinking about calling USCIS and talking to tier 2 to see if they can give me any info (What's best way to get access to a tier 2 support agent?)

3. We have a case number (lawyer submitted it as soon as she got the notice on april 10th - no reply yet) Is there a way to call to get more information on this?

 

Thanks guys, I just can't wait to figure this out so I can stop panicking. I can't imagine this falling through -i'd be so gutted.

I called USCIS they said tier 1 and tier 2 both can't tell if it's a RFE which kind of puts me in a sticky situation.

They said since it has been 30 days with no response , that I should make another support ticket/e-request which I did. 

Can someone give me any guidance? I've spoken to our post office, wrote our names on the mailbox. Feeling lost and kind of dreadful, I'm worried it was an RFE and now it's too late to reply and we are screwed.

If the tier 2 rep couldnt see anything then theres nothing more you can do. You can try contacting them again and see if someone else can see anything. They also may not see anything. So just try to calm down- its all you can do. If it becomes an issue the attny will deal with it. You shouldnt be auto denied but if you are theres ways to appeal it.

I am in this kind of situation right now, but have taken some steps I found online for similar situation, 1, re-request for the undelivered documentation, 2 go to change of address even when the address is the same since February 9, the only response I got up to this moment  is.  

  • We will return your document if we are able.  Please update or verify your current address information.  If we destroyed an undeliverable document, please follow our instructions. 

  • List Bulletand on the page of checking case status for i130 is still showing notice was returned, am really confused right and don't know what to do, please can someone help me with phone numbers for the level 1 and level 2 officer  I can call to find if my case is still on track thanks
