Hi forum,

Asking thai question for a friend. Here is what they wrote to me:

"I was admitted to a US university and I intend to begin studying in the fall semester 2018. I have applied for a student visa (did not receive it yet, pending interview). I have also just learned that my father was selected in the DV lottery and intends to file DS260 applications for himself and our family sometime in the summer. I am 17 y.o. (we are from low-immigration country)
Generally I did not intend to remain in the US upon graduation, however, having been selected in the lottery may change things. What should I do? Should I let my father file my DS260 while in college here and then fly to my country for the interview?
Should I deter admission and pursue this potential green card through my father in my country?"
Could you please help/advise if anyone has similar experience? Thank you!

I think this is more like personal decision you have to make, though.

To qualify for the student visa, he needs to show his intent to return home at his interview and when he enters the country.

 

Here is the main problem that I see.  DV 2018 will be over on Sept. 30, 2018.  How is he going to enter the US in Fall 2018 on a non-immigrant student visa and explain he doesn't have immigrant intent and still file the DS-260 in time for the limited DV visas at the end of the fiscal year?

 

Defer admission.  File a DS-260 as a qualified derivative and get an immigration visa.  Pay the lower in-state tuition rather than international student tuition.  

It's simpler to settle his immigration status before starting school.
