Hello there,

My wife got here using the k1 visa, we got married and applied for AOS. As many others have mention my wife is currently under AOS, we are waiting for her interview. She applied on May 26, 2017 for AOS, EAD, and AP. Her EAD and AP was approved and we received her card on September 2017. However, It expires on September 2018. For the last 7 1/2 months her AOS has been on "waiting for interview" (it's taking forever). So I want to renew her EAD and AP before it expires. My question is if I need to pay any fees? I've been reading a lot of posts saying the fee is waived, but does that include the biometrics fee? Or just the application fee? I've read from the other people say the application was rejected because it didn't include the fee. What supporting documents should I send to renew my 765 (EAD)  and 131 (AP)?

If you don't get a better answer than this, here's my 2cents' worth. Send in the application for extension now, with no fee. If it is rejected for no fee that doesn't mean it's denied - it just means you need to re-send with a check. If you apply now, and they send it back, you still have time to re-send it before her current document expires.

Send it with your NOA1 from your AOS. (The NOA1 for your i-765 has the category written on it).This way you will have fees waived. This information is also included in the instructions for i-765 on page 16.

 

"Renewal EAD. If this is a renewal application and you are applying under one of the following categories, a filing fee is not required:

  1. (a)(8) Citizen of Micronesia, Marshall Islands, or Palau;
  2. (a)(10) Granted Withholding of Deportation;
  3. (c)(l), (c)(4), or (c)(7) Dependent of certain foreign government, international organization, or NATO personnel; or
  4. (c)(9) or (c)(16) Adjustment applicant who applied after July 30, 2007.

"

"NOTE: If you filed Form I-485, Application to Register Permanent Residence or Adjust Status, as of July 30, 2007, and you paid the Form I-485 filing fee, no fee is required to also file a request for employment authorization on Form I-765. You may file the Form I-765 with your Form I-485, or you may submit the Form I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of Form I-485 as of July 30, 2007. "

That's what I meant with your category. You have to put the one that you put in your first i-765 (I hope you have a copy of that) otherwise you can see your category on the NOA1 for your i-765 that they sent you.

It is your application, I can't tell you what to put:

Thanks! Yeah I just noticed. It says C09P .. so it's C9 category .. the filling fee is not required but does that include the biometrics fee?

It’s free and you can apply up to 180 days early, so you can definitely apply for renewal now. Biometrics fee isn’t required.

 

 Like others said, make sure you include a copy of your i485 receipt notice and a copy of front and back of your current EAD and other documents (photos) per instructions.

Thanks, I also want to renew I-131 Advance Parole to travel. Do i include the form in the same packet to same destination or I submit the form in a different envelope with a  copy of everything again?
