Yes, a consultation with an attorney is absolutely worth doing, imo.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Just make sure you have her ask a PI lawyer. If they catch wind of a USC boyfriend they may try and tell her it's worth a fight to get you to pay a hefty bill even if they know it's a loss cause.

Im leaning toward no but i forgot about the corruption over there. 

The cold facts are sobering.......but needed.

getting an immigration lawyer and fighting that fight.

God knows how much all that would cost.

Most people who commit passport/visa fraud don't think what they are doing is criminal; even though they know that kind of fraud is criminal.  They think that they will never be caught or there will be no repercussions beyond a slap on the wrist.  They think that it can easily be overcome.  This is based on my own experiences with people from my old country, they don't think fraud is a big deal since corruption is part of their daily lives and there's always a fixer.

Here is the road you are headed down if you continue with this and only you can decide if the relationship is worth pursuing.

1.  Her confidence that this issue can be overcome may be misplaced.  The US takes immigration fraud history seriously.  Even if she can get a new passport, her US immigration problems don't disappear.  

2.  It will be drawn out . . . years and $$$$$$$$$$$$$$$$$$$$$$$ and it may not end in the way she wants.
3.  Be prepared for her to tell you she needs thousands of dollars for a guy who can fix this problem and make it go away.  (If she tells you this, then you should run IMHO.)

at the very least........what i will do is at least get a professional opinion on the matter but 

if that opinion is even slightly doubtful. I would have to lean toward not taking this battle. 

 

I mean just the criminal potential alone is troubling. 

So basically she can go on working overseas and supporting her family or take a risk and go to prison

and then definitely never qualifying for a passport again.

Also... note.. how much did her aunt know about this? She may also be brought up on charges of knowingly letting her niece falsify documents/ lie on official forms and all too... this may be opening up a lot more than that family may want to.

Wanting to work overseas and support her family is admirable.  However, by continuing to use the fraudulent passport, it doesn't show any remorse.  That's not going to help her case for US immigration.

Consult with several lawyers in the US and the PI.

Sorry if this sounds pessimistic, but she made her bed and she may have to lie in it without you.

Yes her aunt was aware of it. but you're right. they would both be in trouble. 

 

and its not possible to say the aunt didnt know, she lives with them. and she sent money back 

to build a house that her aunt lives in. :/

So regardless of the outcome legally, the family may not want to disclose it anyways for that reason.

 

Have you met this girl in person or just talked online/skype/or whatever.

only online facebook, skype etc. 

but I just recently bought tickets to go meet her for the first time in late august.

You should definately like we have said have her consult an attorney potentially to see what the legal ramifications could be; but I wouldn't get hopeful for just  small fine and slap on the wrist. Doesn't hurt to just find out.

It's not identity theft.  Sounds like the aunt allowed her to borrow her identity.  Technically, it's fraud.

 

OP,

Like others have said.  Is it worth it?  It sounds like you are taking this criminal activity quite likely, almost like it's no big deal?

 

Also, what kind of work did she do abroad?  Make sure that she wasn't working as a hooker, an underage hooker at that.

Why did you have to go there?  Where are you getting that she might be working as a hooker?  You realize that the PI is a big source of domestic help across the world right?

she was a live in chef/maid. I met the saudi family and everything that she worked for. it was nothing like that. 

im not taking it lightly. 

just being willfully naive.

This is going to sound super harsh but..

You only know each other online for 6 months and never met in person...

 

If I were you I wouldn't get myself involve in relationship like this. Unless you have lots of money for lawyers, desire to move to Philippines, lots of patience..  .. I'd just call it a day.
