Hello,

 

My husband is adjusting from a K1 visa after marrying last month. We submitted the AOS/EAD/AP paperwork about a month ago and already had the biometrics done last week. I make far above 125% of the poverty line, as displayed on the I-864 I filled out when we submitted AOS. I also submitted tax returns from the previous 3 years showing the same.

 

I recently received acceptance to a full time Masters program which has openly stated we can not work while studying. It is a 2.5 year program which would begin in September 2018. 

 

So, how would this effect me? I have been so stressed about this and need to give them an answer by tomorrow. I would no longer make 125% above the poverty line starting in September. However, I may meet that mark by September for the entire 2018 year, I would no longer be receiving paychecks afterwards. I know we won't have an interview before September since we just got married last month. Do I need to prove I make above the threshold during our AOS interview? Would this effect me when ROC comes down the line in 2-3 years?

 

Any advice is welcomed. Thank you so much.

I wouldn't go to the interview without the financial situation settled. It's best to get a joint sponsor and bring a new i-864 with you. If they don't ask, you're good, but i understand living and work situation comes up a lot in interviews.

so what do you suggest in this case? , if some applicants fill I-865 with supporting documents and send it along with AOS and after biometrics, they change their jobs due to some facts.So when they are scheduled for the interview they shall refill a new I-865 form with the new employment and include supporting documents, or just recopy the old form and say your petitioner job has changed?

because in the interview notice they dont say updated I-865 form and they add between bracket (unless already submitted)

I am actionally facing this issue since my interview is this May 30

Do you have advises?

Do not recopy the old form.  They already have it and it's of no additional value.

Bring an updated I-864.  (Not I-865, Sponsor's Change of Address).
