hi guys! I just need an advice here. I had an interview on april 17th, the consul gave me a white slip stating that I am unable to issue a visa since the support from my petitioner wasnt enough - 212(a)(4). The consul says that they will retain my papers at the embassy until I could submit a proof of income of my husband once he gets a job. (FYI: my husband still in school when I had my interview) my 1st question here is, in this situation do i need to file a waiver before i could submit the requested documents?

My husband is now working full time and he could get atleast $1450 per month. He just started 1st week of MAY.We are planning to submit his proof of income by first week of JULY, and aside from that his mom got a raised in april and

she is our co-sponsor (she now earns like $36k per year).so we could present atleast 2months of his payslips and 3months payslips of his mom. So do u guys think this would be enough to present at the embassy? and How long can we wait until we here from the embassy after submitting the documents?

K3 VISA:

09/20/06 - I-130 Sent

10/03/06 - I-129F sent.

10/10/06- I-129F NOA1

11/28/06 - BOTH I-129F & I-130 approved!!!!

12/27/06 - NVC Left case no. assigned MNL 200685XXXX

07/24/07 - OMG!!!! I cant believe it I got my K3 Visa in hand!!!

08/09/07 - Arrival in the U.S - POE at LAX

AOS:

08/27/07 - Sent AOS and EAD

08/29/07 - Chicago Lockbox received both AOS and EAD

09/18/07 - Checks cashed 09/21/07 - NOA on both AOS and EAD

09/27/07 - Received Biometrics Appointment Notice

10/18/07 - Biometrics

10/19/07 - Received RFE

10/26/07 - USCIS received the response to our RFE

11/05/07 - EAD Card Production ordered

11/16/07 - EAD Card received

11/26/07 - Received interview notice

01/25/08 - Interview Date!!!! APPROVED!!!

04/18/08 - At long last! GC Card production ordered

04/21/08 - Email noticed welcome letter

04/23/08 - Email card production again

04/25/08 - Welcome Letter received

04/30/08 - Greencard received

You were temporarily denied until you can meet the requirement of proving that the beneficiary will not become a public charge. You were not instructed to file a waiver as waivers have nothing to do with the public charge requirement.

Submit what they request and prove that you will not become a public charge and you will get your visa.

No waiver needed, you are just submitting overcome documents.

How about getting a joint sponsor? Someone who makes more than enough to provide support either until your husband gets the better paying job and you then can file for AOS or can be a joint sponsor on the AOS. Husband's parents, relative, sibling, or even a good friend.

The thing you want now is to show that you will have support from the time of entry until status is adjusted in the USA on the K-3

Fill out a new I-134 form, include updated letters from both the your husband's employer and your mother-in-law's employer documenting the salaries would also be a good idea, along w/ the paylips. (Since both your husband's new job and MIL's raise are too recent and they will not be on tax returns, you need to back it up w/ letter from employer) Also, don't forget to notarize.

Depending on how many dependents the MIL has, her $36k salary should be enough to co-sponsor, if she's only supporting say herself and the intending immigrant. No?

OIC... can i submit atleast 2months of my husbands payslips and contract of employment? His mom is our co-sponsor, I got temporary refusal since his mom only had $30k income (we'll gonna be 5 in the family) but she now have $36k. she got a raise in april.

The poverty guidlines for 2007 are:

# in Family - 100% - 125%

1 - $10,210 - $12,763

2 -$13,690 - $17,113

3 - $17,170 - $21,463

4 - $20,650 - $25,813

5 - $24,130 - $30,163

6 - $27,610 - $34,513

7 - $31,090 - $38,863

8 - $34,570 - $43,213

Your MIL was very close to meeting the requirements last time, to support five people w/ $30K, since you need to have 125% over the poverty guidline. Now w/ her new salary you should be fine. But you need to submit your MIL's new information also, showing she got a raise....letter from her employer. Fill out a new I-134 and get it notarized.

Only the consular officer handling the visa application can answer these questions.

With regard to the second question I suggest that you tell the embassy what your timeline is for providing the additional information so that they do not give up waiting and close the case before you are ready to submit.
