Hi VJers!

So I was a March 2017 filer, during my journey I went through a lot of hardship in my marriage, where my wife would verbally and physically abuse me. I was at a stage of filing where if I switched to a water form id go back to square one so I decided to move out.. long story short I received my permeant green card second week of March in 2018..

I just wanted to ask, is it too soon for me to apply for a divorce?.. As its only been a few months since I've received my card?..

Any advice will be much appreciated

Too soon for what?   If you are being abused, the time to file is NOW!!

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Of course, they will look closely at your case, but you can still remove conditions with an approved waiver.

That should be the least of your worries. No one should stay with an abusive spouse. Leave and start divorce proceedings for your own safety immediately.

Your primary concern needs to be your safety.

I have started divorce proceedings but I was just asking as I don't think I can deal with more unnecessary headache

You should be fine since the marriage was entered in good faith, I'm assuming.

More importantly, keep yourself safe. Since you've already moved out, block/delete all contact, get divorce finalized, focus on yourself and your well-being.

Did you move out while your joint ROC petition was still being processed? And you got the 10 yr GC while separated from your wife but did not tell USCIS you were seperated? If so you may have problems attempting to naturalize.

Yes all the above is correct. In regards to naturalisation I’d rather get a divorce and  just wait until I’m allowed to file
