Expedite process for extreme emergency humanitarian crisis

Does USCIS expedite my petition for k3 visa and under what expedite criteria this case will be considered? IT'S REALLY EMERGENCY AND I KEEP POSTING IN EVERY WEBSITE TO FIND AN ANSWER. I DON'T WANT MY WIFE TO POST FOR HELP IN SOCIAL MEDIA CUZ I DON'T WANT HER TO BE FIND BY THE RELIGIOUS POLICE IN HER HOME COUNTRY. The story is:  My wife and my one year old daughter, I never met since she was born in Saudi Arabia need to leave Saudi Arabia country ASAP . My wife delivered my baby girl in Saudi Arabia I wish she didn't leave USA while pregnant. My  one year old daughter now is without legal papers in Saudi Arabia( no birth certificate, nothing as human) and our marriage that happened in USA, not in an Islamic mosque and without her oldest brother permission neither with her government permission is against Islamic marriage law in Saudi Arabia. So my wife and our daughter are facing persecution and death threatens by her oldest brother who is her gaurdian in Saudi Arabia and by her country to be killed in public for her apostasy cuz her brother told police she committed apostasy. Her country law is base on guardianship ideas and opinions not in Islam!!!!! maybe their male guardians think they are Gods, because it's really slavery for women there in KSA! Men slave women and if the man told the government to kill his wife, daughter or sister, the government takes his words without any questioning!!!!!! My wife is in danger there with my one year old daughter. But I converted after the marriage to save her life, but it didn't work with them. My daughter has no birth certificate in Saudi Arabia where she was born, she was never vaccinated, her mother can't take her to any places like hospitals, daycares because she is illegal there. Her government told her, we can't recognize ur husband and ur daughter and ur punishment should be death penalty. The worst part her oldest brother told religious police to find her and my daughter. Our life is worst than a thriller movie. My wife might be killed, and my daughter may die cuz she was never vaccinated and she can't go to hospitals since she got a deportation paper from the government to leave ksa!!!! And I'm getting so broke since I sent so much money for my wife to take care of herself and our daughter till they leave SA. Now I lost my job and I'm unemployed!!! Which made the situation worst!!!!! Please someone help me. I sent the k3 visa package to a lawyer. I'm waiting him to mail it on Monday, but I need an answer please if this case will be expedited since I hear uscis rarely expedite cases but this is a life death issue!!! Where can I get evidences for this emergency case. I only have my daughter deportation paper. How to proof to uscis that my wife is getting persecuted and death threatens from her brother, and religious police?!!! I only could attach some links for saudi governmental websites that shows the fact of their death penalty punishment. Are these evidences enough for uscis? Please help

Timeline

K3 is effectively dead, very few are processed so sounds like a Cr1. maybe an IR1.

 

Can you file for a CRBA. Is the child eligible for US Citizenship?

 

Do you have a Lawyer?

Why would she leave US though? Probably knowing that will happen when she comes back to her country?

Dunno, I feel like this might be a problem with expedite - I mean, there situation with her family and country is bad but she decided to go back anyway? Why would USCIS give her humanitarian expedite, when she voluntarily went back there?

You see what I mean?

 

Expedites aren't very common.

The forum is probably NOT a place someone can help you with that - talk with lawyers.

She did not know the bad consequences she will go through since she lived for 6 years in USA without visiting her family y and then her mother convinced her to deliver her baby in SA she has problems only with one family member who is he guardian. My daughter got her US passport and CRBA through the us embassy in SA.

She did not decide to go back forever. She just wanted to visit her mom because she and my mom did not get along that time and then her mom and my mom had some arguments on phone , then her mom convinced her to deliver our baby in Saudi Arabia, and my wife agreed cuz she wanted to see her mom she didn't see for 6 years.

What was her status in the US? You never help her get a green card?

Was she illegal for 6 years?

 

Because that will be additional issue - 10 year ban.

Yes I haw a lawyer who is already working on the visa application, but I need to know is there a chance to get yeh case expedited? Will uscis immediately approve the case? And how long it takes to bring them back to USA?

It will not happen immediately.  It will still take few months. 

 

All those questions just ask your lawyer. 

 

If she was illegal in the US make sure to acknowledge her 10 year ban on entering US.

Role, she was studying under student visa in USA from 2011 to 2016. We met in 2015, dated, then we got married after she got graduated from her masters degrees. Yes I feel bad that I didn't apply for green card for her immediately after our marriage, but I wanted to wait till I get promoted in my job, then adjust her status, but instead I lost my job in the same day my wife said she was pregnant. Then we had to move to live with my mom for a while. Well, then her mom decided to get her back to take care of her during her pregnancy. But now me and her wish we didn't let our family get involved between us.

She was legal in USA. She left before her student visa expired.

So she was illegal in the US from 2016 to 2018. She was 10 year ban. What was she thinking leaving US  without any status? She should have known she won't be allowed back. 

 

You will also need a waiver for the ban. Hope the lawyer knows that. 

 

My opinion? She overstayed her visa then voluntarily left US. Good luck with your journey but I sense small chances for expedite.

I know k3 visa is sews but in urgent situations, aren't going to consider giving her k3 visa cuz it the fastest?!! We have been married since 2016, so it's more than 2 years. They may transfer it to Ir1 visa but taut visa takes so long, my lawyer suggested me to apply for k3 visa cuz its shorter. I hope they still do k3 visa in urgent situations at least like mine

So she left in 2016 and you waited 2 years to apply for her to come back? Doesn't show USCIS that this is very urgent... 

 

K3 doesn't exist pretty much. 

I suggest changing lawyers if he doesn't even know that.

These are questions for your lawyers.  They are in the best positions to help answer them for you.
