Visitor who overstayed comes to visit?

I know I will receive heat for this. I myself currently go through AOS. Already received my EAD/AP card. So my relative came to the US and overstayed his visitor visa (Came here on its own, no help from me received). Now there is a discussion between me and my spouse if it's OK if he visits us (to clarify this relative lives in a different state). I say no because it's criminal to harbor someone "illegal". Spouse argues it's just for a visit though. Under any circumstances I don't want to do anything wrong. I said if he comes here it is my obligation and duty to call ICE. Am I right or am I overthinking this?

Them overstaying isn't going to impact you personally. They can visit fine. You're not an accomplice to his illegal activity for wanting to see him. If you were harboring them, then that would be another story.

 

Whether you believe it is ethical to report him or not, or to even let him visit, is a personal opinion.

They tried to pass a law where I live to make it harboring to do that, and it didn't stand up in courts.  So no, you aren't harboring.  You have no obligation to report anyone illegal

Sounds like you just shouldn’t let the relative visit;especially if you’d call ice on them. Just tell them not to come if you’re feeling so unsure about it.

Sounds ore like a personal issue than a legal one. If you are still uncomfortable with the person visiting even though there will be no repercussions, then that is a conversation you should have with your spouse.

If you are uncomfortable with him visiting, do not extend the invitation. It does not matter that you do not plan to call ICE.  It matters whether you want to condone illegal behavior; some people's moral standards are such that they do not want to associate with people involved in any illegal activity. There is nothing wrong with that.  There are people who will criticize if you do not welcome him and say family comes before the law.  Then there are others who if they know you are supporting someone illegally present will disassociate themselves from you.

t is not a great distance for a visa overstay to a felon. If one can take an inch. he is likely toi try taking a foot, yard, and mile.  It is not a "stupid choice" it is a violation of US sovereignty.  When one does not like the rules of one country, they need to go elsewhere.

Which country is that? Certainly not this United States.
