Thanks everyone, your responses have been really helpful! It’s good to know the K1 visa is good for 6 months, for some reason I thought it was only 4. And this is from visa issuance meaning the actual issued date on the visa post interview and medical exams?

For the marriage CR-1 visa, I read somewhere that you have to apply for it in the US, is that correct? My fiancé and I live together in London.

Thank you!!

K1 visa after issuance is valid for entry for 6 months from the date of medical exam.

i-129f the petition is valid for 4 months. You probably read this one.

cr1 is just like k1 and the interview should be done out of US, in an embassy. The petition for it will again start with the us citizen, so the start is in US by the petitioner.(same as k1)

Just like @Naes said the K1 visa is good for 6 months after the medical. But what some people do is let the petition sit at the embassy for a little bit(couple months) so that they have everything they will need for the interview. The CR-1 can only be done outside the USA. What you are thinking of is called the Adjustment Of Status(AOS) in the USA

Since you are both living in London together, then why don't you just get marry and file for the CR-1 spousal visa by DCF.  You would get the visa within the next 6 months.  You would have 6 months to use it.  Once you get to the US, you automatically get a green card.  You could leave the US on the same day and be able to return to the US.   This would solve your problem so much more efficiently.

Why the CR-1 by DCF is better than the K-1 for you;

1.  Cheaper and faster overall than the K-1.

2.  No problem leaving and returning to the US.

3.  Immediate work authorization by not having to wait for 3-5 months for the EAD.

I am considering the CR-1 visa more now, you make some good points since we have concerns about having to wait a while for a work permit and about traveling once we arrive in the US on the K-1. I have read mixed information online about which visa is the better choice for us. Does anyone have other opinions or experiences to share about the K-1 vs. the CR-1?

Thanks all!

Thanks all!

Use the search function and the chart under Guides.  Lots of posts on the pros and cons of each.
