Hi everyone here is my issue, i married my wife in mexico this year and obviously had my US Birth certificate apostiled and was used for marriage out there. The civil registration told me that my birth certificate would need to be kept with them (mexico) and i would no longer have it to my posession. Now, i got a copy of my vital birth record only thing is i just realized that my parents registered my last name as a middle name and my last name as my moms last name (Prior to her marriage with my dad). I want to know if i put my last name on forms I-130 and I-130a will it effect anything in the process since my birth record which i will be submitting for proof of us citizenship has my last name under as my middle name? Please any help would be greatly appreciated, thanks alot.

I feel like I’ve seen a very similar situation to this recently somewhere on the forum.

 

How are all your other ids setup ?

 

there is space provided for you to explain the situation. 

 

My father was not present during birth so I got my mothers last name. My dad got an affidavit to change shortly after. I now go by my married name which I used but on all forms I also indicated my original name at birth and which is listed on my birth certificate exactly as it appears and my fathers name which I count as my maiden name. I explained the situation in the space provided and gave copy of affidavit.

My other id's are set up normaly with my last name being my last name in which in my birth certificate states my last name as my middle name.

If it were me, I’d write my name as I regularly do in main sections, list the name on the birth certificate as an additional and explain the reasoning in the space provided and send copies of a couple different ids along with your birth certificate.  It shouldn’t  create any problems since your ids show the name correctly and the birth certificate is the only thing that is mistaken.

Use the name on your passport and use a copy of your passport as your evidence of Citizenship instead of your birth certificate.

On the I-130 checklist #4 it states the following "ALL pages of the US Citizens passport." or can i just submit a copy of pages 2-3 of my passport?

All pages.  Make color copies for legibility.

follow the instructions.

 

it says ALL PAGES.

 

that is what you submit.

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1
