  1. Possible? Yes. Likely? No. Any entry into a government building has added risks, more-so with federal government buildings than state or county buildings. They likely do not have anybody from ICE sitting there waiting for somebody to apply for a marriage license.
  2. I'm not sure why you've evaded the most important question here multiple times...did he enter the US without inspection ("jumped the border"), or did he overstay a visa? This is the crux of what options you have next.
    1. If he entered with inspection and overstayed his stay, then you can marry and file an I-130 + I-485 (plus other forms to go with them, and an EAD + AP). he can stay in the US while that processes.
    2. If he entered without inspection, then you can marry and file an I-130. An I-601A can be filed to provisionally waive the bar he will receive when he exits the US to interview for the visa abroad. He will need to interview abroad.
  3. There's a whole list of documents and samples of bona fide marriage evidence in the guides.

You can't make your own ID card.

 

Get married.  File the I-130 and the I-601a. 

 

Suggest a lawyer too. 

I'm going to take a wild guess and say her fiance is possibly a Mexican national. In that case, yes, they get a consular ID card along with their passport at the same time. This could be what she meant by making an ID card when he got the passport. 

 

Did her overstay a visit visa? Or just cross without inspection.....that will make a world of difference.

**Adjusting from initial Q1/changed to B1 then overstay, termination of removal proceedings**

First met: Totally random by asking for directions, June 2014 while on vacation at Disney World (L)

Engaged: Aug. 21, 2014

Married: Dec. 1, 2014

ICE phone contact: sometime in early Dec. 2014- Co-operated, retained attorney who advised the same.

Filed stand alone i-130: January 2015 (VSC)

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

Did he enter the country legally? Does he have a valid passport or any other form of government issued ID? In order for you to be able to help him adjust status, he needs to have come in legally and overstayed. Marriage to a US citizen will forgive any overstay and they came in passed inspection. If he sneaked across the border without going through inspection, then marriage to you will not help much. He will have to go back to his home country after getting married to you and file for spousal visa but as soon as he leaves the country he will trigger his ban, most likely 10 years. If he came in legally and overstayed you just get married and adjust status. There is always a risk of getting caught anywhere anytime for deportation. There’s nothing you can do about that. However you need to get married as soon as possible in order for him to fix his situation however that may be. The longer you wait, the more he’s at risk.

He could be arrested and deported for jaywalking at this point.

Assuming he is from any latin american country, not an issue getting a passport. They all issue passports to their own citizen. ID problem solved

I think the "elephant standing in the room" is how he entered the US.  For some reason, the OP has evaded that question.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

yes, that is a problem not having inspection. i have heard of people going back to their home countries and getting waivers, but those are 50/50 chances always. With this administration...good luck with waivers.

If a waiver is needed due to EWI, they can do an I-601A. While no waiver is a guarantee by any means, any decent case stands a strong chance for approval for this circumstance while still within the US.

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
