Got divorced and wanna remarry again

Guys me and my us wife got divorced and we wanna get marry again 

I have conditional green card and we suppose to apply for permanent green card next October 

my question is ..

is there any problem to get marry again?

what about our case in uscis is it still going on or we are going to apply from the beginning or how it works ?

USCIS will definitely want to know for sure if you didn't just got married again for the sake of you ROC to be approved. Expect extra question during your interview.

 

You will have to disclose the divorce and second wedding in your ROC paperwork.

09.2015 - Green Card received.

24.07.2017 - NoA1.

Not a problem to get re-married, extra scrutiny may arise during the interview however as pointed out above.

Submit a copy of your original marriage certificate, a copy of the final divorce decree, and a copy of the 2nd marriage certificate with your ROC application.

You should speak to an attny. Get a free consult.

 

I believe you will need to fill out the ROC with the divorce waiver tic box and you will be unable to file ROC as joint. You will disclose on your ROC that you are married (to the same person). However to file ROC jointly the marriage still needs to be in effect. It is not. You are remarried. So they are looking at the marriage that took place apx 2 years ago, and that has ended in divorce.

i walked to attorney who told me if u get marry again ur gonna need to apply for new case again in the immigration 

is that correct we need apply again for new case or our case in immigration still going on ?

So you got the 2-year GC with your wife. Then you got divorced. Now you are re-marrying the same woman. Your deadline for filing removal of conditions (for the 10-year GC) is October 2019. Is this correct?

 

For divorced couples, the permanent resident can still file for removal of conditions as long as paperwork of the divorce is provided. I don't know why your lawyer is saying you need to start from scratch all over again. I don't think the divorce really matters too much because you're planning on getting re-married to the same woman, who was your original US citizen sponsor anyways. However, it'd be best to see what other people say here and perhaps get second and third opinions from other lawyers.

Because the marriage in which the original petition was based on is no longer in place.

 

But as was mentioned above, you can attempt ROC on your own with a divorce waiver

 

Not 100% sure but I would NOT remarry until the I-751 is resolved

Yes the divorce isn't really a big deal. But I have no idea how the re-marriage will affect the process, which is why I think OP should get second and third opinions from other lawyers.
