If you specifically don't want to consider it an official "executive agreement", the State Department had a response to that as well - https://www.state.gov/documents/organization/65728.pdf

 

Ultimately the only way it could have been officially ruled "unconstitutional" or whatever you want to call it is if a case was brought to the Supreme Court. It wasn't, so that's the end of it.

 

Rather than focus on what happened, we should focus on what is happening now. We are trying to come to an agreement with North Korea and trying to convince them to stop their nuclear weapons program. If we want that to be an "official treaty", as so many people have argued the Iran deal should have been, Trump will need a 2/3's majority. He could go the route of a joint Congressional/Presidential agreement which "only" requires a simple majority in both the House and Senate. That is doable for him right now, but still difficult.

 

As i said I wish him well. He would have had more options in his pockets if he hadn't ended the Iran Deal. We'll see what happens.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

But seriously this isn't something to celebrate. It is more something to potentially say "I told you so" about. A lot of people were celebrating the peace talks a little early. I sincerely hope there is something to celebrate in the end but we shouldn't be counting chickens before they hatch. First it's the threats, then it's actually coming to an agreement, and THEN it will be Trump having to take whatever agreement/negotiation is reached and bring it back to Congress for approval as a Treaty. Considering he made such a big deal about that in the past. 

 

If the agreement involves NK stopping their nuclear program I have serious concerns. How will we be really sure? If we submit them to independent checks by say, the International Atomic Energy Agency, how will we be really sure that they aren't just hiding it underground? Even if all the checks are clean, they could still be developing weapons. We did 100% access to 100% of everything at any time, with no delay. No negotiations on that. Anything less wouldn't be sufficient and I would expect Congress not to approve it.
