Hi thank you for your opinion:)  yes i am ready and prepared for the possible questions that they were going to asked me.. so it means your devorced before and now applying a k1 visa? How long have you been devored? Is it a filipino ?

I don't understand why you are even asking for help? In every answer that someone is giving you here, you are saying that you don't think there will be a problem at all for you to apply. So what is the issue?
Also, how is a lawyer going to be able to help out in this case? Can you provide why your previous visa was canceled?

My previous visa was cancelled because i decided not to continue our relationship since my x fiance made a decession first after my visa issued he has encounter problems that he think he could not handle one her mom just died during the time of waiting my interview and then when the time that i almost had my interview hes financial was not good enough as well because he paid for her mother funeral and also he think that  he cannot provide me once i get to US so he panic and told me that he dont think so that i could fly to usa because of facing problems. So after that we are not contacting almoat 6 months and after that he realized that he made mistakes and asked me a second chance to replace a  visa in order for me to come to US i did try but i realized and think so much about it so my final decession is to stay here in Philippines and think that he is not the one for me   and so i asked him to withdraw the visa. My new boyfriend was hiring a lawyer because he cant do on his own and he is busy as well so he scared that he maybe mistakes on how to prepare the packet properly thats the reason why he hire a lawyer and also on my situation on my previous visa.

As others have stated, if your previous petition has expired and you have received notification as such, then absolutely you and your boyfriend are free to apply for a K1.  You may or may not receive additional scrutiny and should be prepared.  Your boyfriend will still need to do all the work to gather the documents for the application, all a lawyer can do is review and assemble the packet.  This will not guarantee approval. 

 

Aside from that, I would recommend that you spend a longer period of time getting to know your new boyfriend.  5 months is not a long period of time, especially for a long distance relationship, and as you have learned from your previous relationship, anything can happen that can throw a relationship on the rails.  Take your time and if you love each other, with God's help, it will all be well in the end.

 

My now wife and I were dating for two years before we applied for K-1 and used that time to get to know each other and discuss not only how much we loved each other but also our future, our lifestyles, and reading through problems we have read about on Visa Journey discussed how we would react.  We are not perfect, but it helped us to be a stronger couple knowing enough about each other to understand not just with what we love about each other, but the differences as well.

This is the best responce i ever had and waited and need  in my concern.. it really helps me alot  thank you so much for your appreciating comments and opinion it helps me to enlighten that nothing is impossible as long as in yourself it is real and genuine...i will noted this brilliant advice:)

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
