Re apply a new k1 visa

I believe you  will be ok, but you need to be prepared with all the truth about you preview case, the good thing is you had a K1 Visa and did not use it, it proves that you are not just trying to go to USA, But I can imagine the consul trying to dig very deep on the validity of your present relationship, you will need extra effort proving that this time is serious, and give a very convincing reason why you did not use your K1 Visa.
I am wondering what different this is from a K1 or K3 resulting in a divorce and the US Citizen try again with another fiance!!! Cause that is my case now !!! :D

Keep in mind that there are 196 countries that can apply for visas throughout the world. All of them have different customs, different ways things are looked at in the interview stage, different traditions within the countries, etc. .

What may (or may not) be a problem in the Philippines may not be an issue for someone from the UK. What is an issue in Nigeria or Mexico may not be relevant in Canada or France. 

Lawyers may know the US laws - and yes, they are correct that you can apply at any time - it doesn't always mean they can keep track of all 196 countries and what happens at a consular level in each of them. 

 

Applying doesn't mean that it will get approved at the consular level - it doesn't mean they won't be harsh with their questions either. 

If you are concerned about how close you got the cancellation to applying for the new one, you can always wait and apply later - get to know your fiance more, visit one more time, before applying, to strengthen your application.

You are confusing being able to apply with the chance that it will be approved. You can file, but what you want to know is the likelihood that it will be successful. Maybe I missed it, but why was the first K-1 allowed to expire? Death? Changed his/your mind? That's going to be the big question. Because at this point, it certainly looks like your trying to get to the U.S. - very common in your country. My opinion is that you will be denied. Why? Because you got a new U.S. boyfriend before the first one expired or shortly thereafter. Coincidence? Maybe, but doubtful.

Maybe a better option is to go the CR1 Visa route. Taking about the same time as K1 now a days, and I'm no expert, but maybe a few other senior members can comment on this. Since you are applying for a completely different visa the fact you tried for a K1 may not matter as much. And it will save you some cash in the long run. I think lawyers love K1 visas because they know 99% of the time you will come back for help with AOS, and the ROC, so more money in their pocket each time. Maybe you can work a deal for all the paperwork (AOS, ROC, N400) can be thrown in for one price.

I'd give it a slim chance you will be approved for a K-1 visa if your other K-1 withdrawn was just a few months ago.

I agree with those who say it looks like you're visa shopping. If you want to be with this man, I'd say meet each other a few other times, get married and apply for the CR-1 visa. 

Edit: oh, not even a few months ago. Expired literally 8 days ago. Well, good luck to you. Keep us updated if you go the K-1 route and how that works out for you.

Do you think CR1 is the best choice than a new k1 visa?  Of if we hired a lawyer and work a deal for all the paperwork is it working positively that i am surely approved?

Is the CR1 is best for us since i had a previous k1 visa history?  My previous k1 visa issued is sept 6-2017 and expired last feb 24 2018 and my visa was being cancelled last month april 7 2018 and now i am in a relationship for 5 months and we may apply maybe next month or after 7 months we will apply ..i hope and pray we choose the best one

See it from the other side, if you were the interview officer; would you be skeptical of someone who was petitioned for in 2017, had her visa issued in Sept 2017, let it expire and is already thinking of applying for another K-1 visa all within this time span? 

You need good evidence that this is the man-to-be. Usually Manila is not that tough when it comes to K-1 visas but like I said, if you want a good chance, you will have to prove that this time you will be with the petitioner.

Not sure what you  mean by "work a deal"---no lawyer can guarantee an approval.

It doesn’t matter if you didn’t use it. It was filed for you and it’s on your permanent record. They will question you more because of it.
